2. The Parties shall as soon as possible inform each other of any amendment to their competition laws, as well as of any amendment to other laws and regulations and of any change in the enforcement practice of their competition authorities that may affect the operation of this Agreement.
2. Furthermore, although it is true that Regulation 1/2003 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty, has introduced a great number of amendments to the rules of procedure relating to European Union competition law, there is nothing in those rules to suggest that they require lawyers in independent practice and in-house lawyers to be treated in the same way with respect to legal professional privilege, for that principle is not at all the subject-matter of the regulation which aims to reinforce the extent of the Commission’s powers of inspection, in particular as regards documents which may be the subject of such measures.

In order to reflect the changes made by the Treaty of Lisbon to the previous Treaties, as regards space and sport, in the names of the Council’s configurations, the title of the ‘Competitiveness (internal market, industry and research)’ configuration should be amended by the addition of the word ‘space’, and the title of the ‘Education, youth and culture’ configuration should be amended by the addition of the word ‘sport’.

whereas Article 149 of the EC Treaty as amended by the Lisbon Treaty calls on the Community to promote fairness and openness in sporting competitions, and whereas the application of competition rules to sport is leading to a widening gap between sports clubs to the advantage of the richest, or most popular, which is harmful to the fair conduct of sporting competitions and therefore contradicts the objective laid down in that Article,

In its report, the Commission shall assess whether, in the light of developments in the market and with regard to both competition and consumer protection, there is need to extend the duration of this Regulation beyond the period set out in Article 13 or to amend it, taking into account the developments in charges for mobile voice and data communication services at national level and the effects of this Regulation on the competitive situation of smaller, independent or newly started operators.
2. Whereas in the Member States insurance undertakings of different legal forms are in competition with each other; whereas undertakings engaged in the business of direct insurance customarily engage in the business of reinsurance as well and are therefore in competition with specialist reinsurance undertakings; whereas it is therefore appropriate not to confine coordination to the legal forms covered by Directive 78/660/EEC, but to choose a scope that corresponds to that of Council Directive 73/239/EEC of 24 July 1973 on the coordination of laws, regulations and administrative provisions relating to the taking up and pursuit of the business of direct insurance other than life assurance (7), as last amended by Directive 90/618/EEC (8), and to that of Council Directive 79/267/EEC of 5 March 1979 on the coordination of laws, regulations and administrative provisions relating to the taking up and pursuit of the business of direct life assurance (1), as last amended by Directive 90/619/EEC (2), but which also includes certain undertakings that are excluded from the scope of those Directives and companies and firms which are reinsurance undertakings;
