In its Altmark judgment, the Court stated that public service compensation does not constitute an economic advantage in the meaning of Article 107(1) of the EC Treaty if all of the following four conditions are met: 1. the recipient undertaking must actually have a public service mandate and the tasks and related obligations must be clearly defined; 2. the parameters of the compensation must be established in advance in an objective and transparent manner; 3. the compensation must not exceed the costs incurred in discharging the public service mandate; 4. in order to ensure the least cost to the community, the company which is to discharge public service obligations is chosen either through public procurement, or the costs of providing the services of general economic interest are determined on the basis of the costs of a typical, well-run undertaking.

If Member States wish to keep State aid schemes in place for rail freight transport services which do not fulfil the specific conditions defined in the Altmark judgment (16), they must notify those schemes to the Commission so that they can be approved in advance.

They considered that they fulfil the criteria laid down in the Altmark judgment, which means that their PPAs do not constitute State aid within the meaning of Article 87(1) of the EC Treaty.

On the subject of investments, I would like to point out that there are very important aspects relating to public transport which are affected by the Altmark judgment, a key judgment which will have to be taken into account not only in relation to the transport sector but in relation to all public services in the European Union and in relation to the introduction of competition and the possibility of public support in order to guarantee a certain level of service, but in a transparent and competitive way.

The Altmark judgment confirms the Ferring judgment and specifies the conditions under which compensation on the basis of public-service obligations can avoid classification as State aid.
