Definition: This category differs from others in that it includes disorders identifiable on the basis of not only symptoms and course but also the existence of one or other of two causative influences: an exceptionally stressful life event producing an acute stress reaction, or a significant life change leading to continued unpleasant circumstances that result in an adjustment disorder. Although less severe psychosocial stress ( life events ) may precipitate the onset or contribute to the presentation of a very wide range of disorders classified elsewhere in this chapter, its etiological importance is not always clear and in each case will be found to depend on individual, often idiosyncratic, vulnerability, i.e. the life events are neither necessary nor sufficient to explain the occurrence and form of the disorder. In contrast, the disorders brought together here are thought to arise always as a direct consequence of acute severe stress or continued trauma. The stressful events or the continuing unpleasant circumstances are the primary and overriding causal factor and the disorder would not have occurred without their impact. The disorders in this section can thus be regarded as maladaptive responses to severe or continued stress, in that they interfere with successful coping mechanisms and therefore lead to problems of social functioning.

Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. Definition: A disorder in which the child, having previously made normal progress in language development, loses both receptive and expressive language skills but retains general intelligence; the onset of the disorder is accompanied by paroxysmal abnormalities on the EEG, and in the majority of cases also by epileptic seizures. Usually the onset is between the ages of three and seven years, with skills being lost over days or weeks. In order to simplify the lives of heirs and legatees habitually resident in a Member State other than that in which the succession is being or will be dealt with, this Regulation should allow any person entitled under the law applicable to the succession to make declarations concerning the acceptance or waiver of the succession, of a legacy or of a reserved share, or concerning the limitation of his liability for the debts under the succession, to make such declarations in the form provided for by the law of the Member State of his habitual residence before the courts of that Member State.

When exercising such residual powers, however, the administrator(s) shall respect the law applicable to the succession as regards the transfer of ownership of succession property, liability for the debts under the succession, the rights of the beneficiaries, including, where applicable, the right to accept or to waive the succession, and, where applicable, the powers of the executor of the will of the deceased.

In concrete terms, the Commission requests the Member States to: a) encourage initiatives aimed at heightening owners' awareness of this problem and at informing and training them in preparation for a transfer; b) create the right financial environment for successful transfers; c) make it possible for the owner to adopt the legal form (notably that of a limited company) most likely to ensure the success of the transfer by eliminating the legal and fiscal obstacles that hamper preparatory operations; d) safeguard the principle of continuity of partnerships in the case of the death of one of the partners; e) stipulate that a partnership agreement takes precedence over the unilateral acts of a partner; f) ensure that family law, inheritance law and the payment of financial compensation cannot jeopardize the survival of the business; g) reduce taxation on assets in the event of transfer by succession or by gift, provided that the heirs continue to operate the business; h) allow payment in instalments or deferred payment of gift and inheritance tax; i) ensure that the assessment of the value of the business takes into account changes in its value after the death of the owner; j) provide tax incentives for transfer by sale during the lifetime of the owner; k) provide tax incentives for the takeover of the business by employees.
Concrètement, la Commission invite les Etats membres à: a) encourager les initiatives visant la sensibilisation, l'information, la formation des chefs d'entreprises et partant, la préparation de leur transmission; b) créer unenvironnement financier favorableà la réussitede latransmission; c) permettre à l'entrepreneur de pouvoir adopter la forme juridique la plus appropriée et notamment le statut de la société anonyme, pour réussir la transmission en éliminant les obstacles juridiques et fiscaux qui gênent les opérations de préparation; d) prévoir le principe de la continuité des sociétés de personnes en cas de décès d'un des associé; e) prévoir la primauté du contrat de société sur les actes unilatéraux d'un des associés; f) veiller à ce que le droit de la famille, le droit successoral et le paiement des compensations financières ne puissent mettre en péril la survie de l'entreprise; g) alléger, à condition que les héritiers poursuivent l'activité de l'entreprise, l'imposition des actifs en cas de transmission par succession ou donation; h) permettre l'échelonnement ou le report du paiement des droits de donation et de succession; i) veiller à ce que l'évaluation fiscale de l'entreprise puisse tenir compte de l'évolution de sa valeur après la décès de l'entrepreneur; j) encourager fiscalement la transmission par vente du vivant de l'entrepreneur; k) encourager fiscalement la reprise de l'entreprise par les salariés.

The measures could be targeted, among other things, at the following objectives: - ensuring the continuity of partnerships and sole proprietorships in the case of the death of one of the partners or the owner; - enabling adequate preparation for transfer by providing owners with the appropriate instruments; - encouraging owners to prepare for succession during their life- time, particularly when the transfer cannot take place within the family; - adapting the fiscal treatment of succession to the need to ensure the survival of the business; - preventing international double taxation in the case of cross- border succession.
