Le Conseil a rappelé ses conclusions du 27 février 2006, selon lesquelles la coopération avec le TPIY doit être pleine et entière si l'on veut que les négociations sur l'accord de stabilisation et d'association ne soient pas interrompues, et a répété qu'il était urgent que la Serbie-Monténégro prenne des mesures décisives pour que toutes les personnes inculpées par le TPIY encore en fuite, notamment Radovan Karadzic et Ratko Mladic, soient traduites en justice.

Regarding the conditions of the Stabilisation and Association process, Serbia must be commended for having brought to a fully satisfactory level its cooperation with ICTY, with the arrest and handovers of the last two remaining ICTY indictees, Ratko Mladic and Goran Hadzic.
En ce qui concerne les conditions du processus de stabilisation et d'association, il convient de féliciter la Serbie, dont la coopération avec le TPIY a atteint un niveau tout à fait satisfaisant à la suite des arrestations et des transfèrements vers le TPIY des deux derniers inculpés, Ratko Mladic et Goran Hadzic.

11. Recalls that full cooperation with ICTY is a fundamental condition for Serbia to progress on the path to EU membership; notes that Serbia continues to respond adequately to ICTY requests for assistance and calls on the Serbian Government to continue working closely with the Court, including swift transmission of all requested documents and timely completion of cases transferred back from ICTY; points out, however, the most recent assessment by the ICTY Chief Prosecutor that Serbia's efforts to apprehend the two remaining fugitives continue to be problematic; underlines that only apprehension and extradition of the fugitives to The Hague can be deemed the most convincing evidence of full cooperation and calls for more systematic efforts to arrest them so that the mandate of the Court can be finally fulfilled; in particular, urges a re-evaluation of the current approach, in line with the ICTY recommendations; emphasises that Serbia can only gain candidate status and/or open accession negotiations with the EU if the ICTY Office of the Prosecutor assesses that it has offered full cooperation;
11. rappelle qu'une coopération pleine et entière avec le TPIY est une condition essentielle pour que la Serbie progresse sur la voie de son adhésion à l'Union européenne; constate que la Serbie continue de répondre de manière appropriée aux demandes d'aide du TPIY et invite le gouvernement serbe à continuer de travailler étroitement avec le tribunal, notamment en transmettant sans délai tous les documents demandés et en concluant les affaires renvoyées du TPIY; attire toutefois l'attention sur la dernière évaluation du procureur général du TPIY qui indique que les efforts consentis par la Serbie pour appréhender les deux derniers fugitifs continuent de poser problème; souligne que seules l'arrestation et l'extradition des fugitifs vers La Haye peuvent être considérées comme les preuves les plus convaincantes d'une coopération pleine et entière et demande que des efforts plus systématiques soient déployés en vue de leur arrestation, de manière à ce que le mandat de la Cour puisse enfin être mené à bien; demande instamment, en particulier, qu'une réévaluation de l'approche actuelle soit menée, conformément aux recommandations du TPIY; souligne que la Serbie ne pourra obtenir le statut de candidat et/ou ouvrir des négociations d'adhésion avec l'Union que si le bureau du procureur du TPIY estime qu'elle a offert son entière coopération;

5. The Council calls upon Serbia to implement recommendations presented by the ICTY Office of the Prosecutor to the United Nations Security Council in June 2010 concerning Serbia’s support in ongoing trials and appeals and Serbia’s assistance in the key matter of the arrest of the two remaining fugitives, Ratko Mladic and Goran Hadzic, which would be the most convincing proof of Serbia's efforts and cooperation with the ICTY".

Le Conseil invite la Serbie à mettre en œuvre les recommandations présentées par le bureau du procureur du TPIY au Conseil de sécurité des Nations unies en juin 2010 concernant l'assistance de la Serbie pour les procès et les appels en cours ainsi que l'aide de ce pays sur la question cruciale de l'arrestation des deux derniers accusés en fuite, Ratko Mladić et Goran Hadžic, qui constituerait la preuve la plus convaincante des efforts fournis par la Serbie et de sa coopération avec le TPIY".

34. Stresses that full cooperation with the International Criminal Tribunal for the former Yugoslavia (ICTY), as regards the arrest and extradition of the remaining fugitive indictees, the transfer of evidence and full cooperation before and during the trial process, is an essential requirement of the accession process; urges the Commission to support, jointly with the ICTY, the OSCE and the governments of the region, initiatives aimed at strengthening the capacity and efficiency of national judiciaries engaged in determining accountability for war crimes and other lesser crimes, and ensuring that trials are conducted in an independent and impartial manner and in accordance with the standards and norms of international law;
34. souligne que la coopération pleine et entière avec le Tribunal pénal international pour l'ex-Yougoslavie (TPIY) en ce qui concerne l'arrestation et l'extradition des prévenus encore en fuite, le transfert des preuves ainsi que la coopération pleine et entière avant et durant les procès constituent des conditions essentielles du processus d'adhésion; invite instamment la Commission à soutenir, de concert avec le TPIY, l'OSCE et les gouvernements de la région, les initiatives visant à renforcer la capacité et l'efficacité des juges nationaux qui travaillent à établir les responsabilités dans les crimes de guerre ainsi que dans d'autres crimes moins graves et à garantir que les procès soient menés de manière indépendante et impartiale et conformément aux principes et aux normes du droit international;

À cet égard, le Conseil a noté avec préoccupation que le procureur n'avait pas été en mesure de faire état de progrès dans l'arrestation et le transfèrement des six personnes encore en fuite. Il a exhorté tous les pays concernés à prendre des mesures résolues pour que tous les inculpés encore en fuite, notamment Radovan Karadzic et Ratko Mladic, soient enfin traduits en justice.
