John McKay: With respect to the opening of the Department of National Defence (DND) offices at 3500 Carling Avenue, Ottawa, Ontario, also known as the Nortel Campus: (a) what was the total cost to open the facility for use by DND, broken down by (i) the initial cost to purchase the land and facilities, (ii) the cost to renovate the facilities to make it operational for DND purposes; (b) how many staff are currently operating from the Nortel Campus and is this the full complement that the facility will accommodate, or, if not, how many more is it expected to accommodate; (c) what are the functions that these personnel are engaged in, i.e, human resources, accounting, military command, etc.; (d) what is the time frame to transfer all of the services from the National Defence Headquarters (NDHQ) to the new location; (e) what, if any, services or functions will remain at the current NDHQ location; (f) will DND services at facilities other than NDHQ be moved to the Nortel Campus, and, if so, what services and from which locations, specifying the complete addresses of the buildings and the services, will be moved; and (g) what will be the total annual operational cost to operate the Nortel facility?

The end result of all this will be a sharp increase in operating cost, and the need to allocate huge sums of money from state budgets to cover the costs of drawing up inventories of facilities and adaptations to the latter. It is for this reason that some indication of funding sources is urgently needed.

A Co-ordination Centre is an undertaking belonging to a multinational group providing services to other members of the group. Under a 10-year license granted by the tax authorities, the taxable revenues of a Co-ordination Centre are determined according to the so-called "cost-plus" method. The cost plus method is normally aimed at avoiding double taxation and limiting tax avoidance. In the cost plus method, the taxable profit is calculated as a percentage of the aggregated operating costs. Although this method of taxation does not constitute State aid per se, its practical application may well give rise to State aid. With respect to the Belgian scheme, the Commission has concluded that the Belgian authorities apply the cost-plus method in a way that gives raise to State aid. Firstly, Belgium systematically uses a default mark-up rate of 8% without verifying whether this rate reflects the economic reality of the services provided by the Co-ordination Centres. Secondly, the way in which the expenditure of the Centre is calculated excludes significant operating cost items of the Centre. Thirdly, the Belgian Co-ordination Centres enjoyed additional tax advantages such as a withholding exemption on income distributions and a real-estate property tax exemption. The benefits reduce the amount of taxable profits and thus grants an advantage not justified under the EU State aid rules.
Un centre de coordination est une entreprise faisant partie d'un groupe multinational et fournissant des services à d'autres entreprises du même groupe. Au titre d'un agrément d'une durée de dix ans accordé par les autorités fiscales, le revenu imposable des centres de coordination est déterminé selon la méthode dite "cost plus", qui vise d'ordinaire à éviter la double imposition et à limiter l'évasion fiscale. Selon cette méthode, le revenu imposable correspond à un pourcentage des frais de fonctionnement totaux. Même si cette méthode ne constitue pas une aide d'État en soi, son application pratique peut engendrer une telle aide. En ce qui concerne le régime belge, la Commission a conclu que la façon dont les autorités belges appliquent la méthode "cost plus" constitue une aide d'État. Premièrement, la Belgique utilise systématiquement un taux de marge de 8 % sans vérifier si ce taux reflète la réalité économique des services fournis par le centre de coordination. Deuxièmement, le calcul des dépenses du centre ne tient pas compte de certains frais de fonctionnement importants. The programme, which involves a total cost of LIT 246 000 million over the period 1985-89, will be jointly financed by the ERDF (56%) and Italian public agencies and private investors (44%). The measures provided for in the programme include : a) a package of measures in support of small and medium sized businesses - sectoral analyses on the potential of markets (70% of the cost); - assistance over three years with the operating costs of consultancy firms advising on management or organi- zational matters (55%); - aid over five years for economic promotion services relating to research and the encouragement of new industrial investments (50% of costs per promoter); b) aid for technological innovation in small and medium- sized industrial firms - collection and dissemination among firms of informa- tion relating to product and technological innovation (55% of operating costs over three years); - operations for implementing innovation (70% of the cost of feasibility studies); c) aid for craft industries (information, improving conditions of sale) and for rural tourism (adapting accommodation, tourist promotion).
