Irwin Cotler: With regard to international treaties and conventions dealing in whole or in part with human rights and with Canada’s international obligations in this regard: (a) does the government have any formal or informal procedures for regular review of those international human rights treaties that Canada has not yet signed, ratified, or otherwise accepted; (b) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking conflicts with the Constitution Act, 1867, and if so where can these guidelines be accessed; (c) do the guidelines referred to in (b) specify the standard according to which the government determines if any obligation contained in a treaty or other international undertaking violates any section of the Constitution Act, 1867; (d) has the government engaged in any review of its obligations under the Convention on the Elimination of Racial Discrimination (CERD); (e) does the government have any formal or informal guidelines according to which it determines whether the specific obligations contained in a treaty or other international undertaking require implementing legislation in order for Canada to be able to ratify or otherwise accept it, and if so where can these guidelines be accessed; (f) does the government have a position as to whether international agreements that establish a complaints mechanism or communications procedure for enforcement of the rights and obligations contained therein are necessarily unconstitutional; (g) does the government have a policy as to whether Canada will accept such agreements referred to in (f); (h) does the government undergo review of proposed international human rights agreements that would establish such a mechanism or procedure referred to in (f) on a case by case basis, (i) who is involved in this review, (ii) are the provinces and other inte ...

One should be aware, moreover, that if the Czech government presses its case to change the Treaty, it is far from certain that the Czech Parliament will ultimately ratify the new Protocol. The Bloc Québécois will raise this issue again and will bring forward proposals to restore democracy in the conclusion of international treaties. Such proposals will include requiring the government to present to the House all international treaties and agreements it has signed before ratifying them, requiring the government to publish all international agreements by which it is bound, requiring the vote and approval of the House following an analysis by a special committee tasked with examining international agreements and major treaties before the government may ratify them, and calling on the government to respect Quebec and provincial jurisdictions in the entire process of concluding treaties, that is, all stages of negotiation, signing and ratification.

The Rome Convention is the only instrument of private international law in the Community which is still in international treaty form, with all its drawbacks (possibility for Member States to depart from the common rules by means of national rules or by acceding to multilateral conventions, possibility of entering reservations, limited duration of the Convention); uniform interpretation of the harmonised rules by the Court of Justice: in 1980, the signatory States conferred jurisdiction on the Court of Justice to interpret the Convention, but they took 25 years to ratify the requisite protocols, the Court’s judgments are still not binding on all the Member States, and the national courts are under no obligations in this regard; easier application of the harmonised conflict rules in the new Member States: some of them, it is true, signed a treaty of accession to the Convention in April 2005, but experience with past accessions has shown that several years tend to elapse after the treaty is signed before the Convention comes into force in a new Member State.

The explicit restrictions on arms transfers where there is a breach of obligations under international law, in the case, for example, of breaches of UN arms embargos, of customary law, of international treaties between the contracting parties or where there is a failure to observe international prohibitions on certain weapons, such as anti-personnel land mines, the restrictions, too, on transfers based on use where, for example, it is brought to a contracting party’s notice that the arms being transferred are likely to be used in complete violation of international humanitarian law or of human rights for the commission of genocide or crimes against humanity.

Since both Community and Member States’ competence is concerned, joint action by the Community and its Member States for the deposit of the instruments of ratification or approval is required. The purpose of this proposed Council Decision is thus to ratify the International Treaty on behalf of the Community.

This is also how Community law is supposed to have arisen and, according to the traditional approach to international law, how its validity is supposed to take precedence over national law, either by virtue of transposition by a national implementing law (in the system known as 'dualism') or, ipso iure, as higher-ranking international law (what is known as 'monism').This report starts from the assumption of qualified monism. According to the prevailing doctrine of the primacy of the international legal order, one of the norms obtained by custom and conviction constitutes the basis for the validity of the legal orders of individual States. The latter are subordinate to international law by virtue of the context in which they come into being. Another one of the principles obtained from the basic norm 'custom and conviction create international law' is that international treaties (in other words, non-customary sources of law) must be complied with ('pacta sunt servanda'). Under another principle of international law, the law of States, which are conceived as the primary subjects of international law, is left essentially untouched by international law and that each of those States is itself competent to regulate the validity and scope of international law within its domestic sphere of influence and that States are entitled to develop their domestic sphere of influence inwards.

Also, I may say in pursuance of this, because not all states have accepted our high standards, we have not merely negotiated and led the way to international treaties and multilateral treaties extending protection of the law of the sea, but we have negotiated bilateral treaties with numbers of other countries when the international or multilateral action was slow in coming.
