11. Calls on those Member States which have not yet ratified either the Convention of 26 July 1995 on the protection of the European Communities' financial interests or its protocols (the PIF instruments) i.e. the Czech Republic, Malta and Estonia, to proceed with the ratification of those legal instruments without delay; urges those Member States which have ratified the PIF instruments to step up their efforts to reinforce their national criminal legislation to protect the Union's financial interests, in particular by addressing the existing shortcomings revealed in the second report from the Commission on Implementation of the Convention on the Protection of the European Communities' financial interests and its protocols (COM(2008)0077);

Regardless of its form, Community financial assistance should be granted in accordance with the provisions of Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (the Financial Regulation) and of Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities , except where the provisions of this Regulation explicitly depart from those rules.

When actions financed under this Regulation are implemented, the financial interests of the Community should be protected by the application of preventive measures against fraud, corruption and any other illegal activities, by effective checks and by the recovery of amounts unduly paid and, if irregularities are detected, by effective, proportionate and dissuasive penalties, in accordance with Council Regulation (EC, Euratom) No 2988/95 of 18 December 1995 on the protection of the European Communities financial interests , Council Regulation (Euratom, EC) No 2185/96 of 11 November 1996 concerning on-the-spot checks and inspections carried out by the Commission in order to protect the European Communities’ financial interests against fraud and other irregularities and with Regulation (EC) No 1073/1999 of the European Parliament and of the Council of 25 May 1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF)

12. Reaffirms paragraph 2 of its abovementioned resolution of 16 May 2000 on protecting the Communities' financial interests and calls on the Commission, as a preliminary step, to present, on the basis of the current Article 280 of the EC Treaty, a proposal to extend Regulation (EC) No 1073/1999 concerning investigations conducted by the European Anti-Fraud Office (OLAF) , which would allow the early appointment of such a public prosecutor, whose jurisdiction would be limited, pending the entry into force of the envisaged changes to the Treaty, to criminal offences against the financial interests of the European Communities committed by members and employees of the EU institutions and who would have the task of heading the related OLAF investigations and facilitating the prosecution of such criminal offences in the appropriate national courts;
12. réaffirme la teneur du paragraphe 2 de sa résolution précitée du 16 mai 2000, et invite la Commission à présenter, à titre de première étape, sur la base de l'article 280 du traité CE, une proposition qui, complétant le règlement (CE) nº 1073/1999 relatif aux enquêtes de l'OLAF , permettrait de désigner rapidement un procureur européen dont, jusqu'à l'entrée en vigueur de la modification du traité, la compétence serait limitée aux délits commis par des membres et des agents des institutions de l'Union européenne au détriment des intérêts financiers des Communautés européennes, et qui aurait pour mission de conduire les enquêtes menées par l'OLAF concernant ces délits et de faciliter, à leur propos, les poursuites devant les juridictions nationales appropriées;

Reference may be made, inter alia, to its resolutions of 24 October 1991 on legal protection of the Community's financial interests, 11 March 1994 on the independent power of investigation and inquiry which the Union may exercise for the purposes of legal protection of its financial interests and 15 March 1995 on the proposal for a Council of the European Union Act establishing a Convention for the protection of the Communities' financial interests and on a draft Council Decision on joint action regarding the protection of the financial interests of the European Communities on the basis of Article K.3 of the Treaty on European Union.
