A. whereas the first democratically elected President of the Republic of Maldives, Mohamed Nasheed, who had been accused of ‘terrorism’, was sentenced on Friday, 13 March 2015 to 13 years in prison; whereas a former defence minister and a member of parliament were convicted in the same case of the detention of a serving chief judge accused of corruption in 2012; whereas two of the three judges in the case also testified against Mohamed Nasheed during the course of the investigation;
A. considérant que le premier président démocratiquement élu de la République des Maldives, Mohamed Nasheed, accusé de "terrorisme", a été condamné vendredi 13 mars 2015 à treize ans de prison; considérant également que l'ancien ministre de la défense et un député ont été condamnés dans la même affaire d'arrestation, au cours de son mandat, d'un juge en chef (Chief judge) de la Cour pénale accusé de corruption en 2012; considérant que deux des trois juges de ce cas étaient également témoins contre Mohamed Nasheed pendant l'investigation;

An important test case is coming now with the nomination of a new Chief Prosecutor for the Directorate for Investigation of Organised Crime and Terrorism (DIICOT), following the resignation of the Chief Prosecutor in November.[6] The procedure includes a strong political element in terms of the role it gives to the Minister of Justice.[7] The Superior Council of the Magistracy (SCM) is working on an amendment to the law to change this, and to align appointment of prosecutors on the procedures used for judges, in line with the guidance of the European Commission for Democracy through Law of the Council of Europe (Venice Commission):[8] if this were to be pursued, the next step would be for the government to propose this to Parliament.
Un test important se profile à présent, à savoir la nomination d'un nouveau procureur principal au sein de la Direction des enquêtes sur la criminalité organisée et le terrorisme (DIICOT) après la démission du précédent, en novembre dernier[6]. La procédure comporte une forte dimension politique compte tenu du rôle accordé au ministre de la justice[7]. Le Conseil supérieur de la magistrature (CSM) travaille actuellement sur une modification de la loi pour changer cet aspect et aligner la nomination des procureurs sur les procédures en vigueur pour les juges, conformément à ce que préconise la commission européenne pour la démocratie par le droit du Conseil de l'Europe (Commission de Venise)[8]: s'il devait être donné suite à cette proposition, la prochaine étape consisterait, pour le gouvernement, à la transmettre au Parlement.

In order to help create an independent and impartial judiciary, is pleased with the substantial efforts to further reform the judiciary, in particular with the adoption of the revised judicial reform action plan; welcomes the progress in further reducing the backlog of cases, especially those where proceedings last more than three years, and rationalising the court system by setting up larger courts, county courts and commercial courts as well as by arranging for judges to specialise; notes the positive steps, including with regard to the State Judicial Council, the independence of the Judicial Academy and the establishment of the school for judicial officers, to reinforce the independence of judicial appointments and to improve career development and the disciplinary liability of chief judges as well as the adoption of general safeguards for enhanced independence of the judiciary;

re-establish the independence of Pakistan's judiciary, including its suspended former judges, notably Chief Judge Iftikar Chaudhry, and respect the pending ruling on the legality of his presidency;

Hopes that those responsible for the assassination of Benazir Bhutto are identified and held responsible as soon as possible; notes the worsening human rights situation in Pakistan throughout 2007, including in particular the threats to the independence of the judiciary and the freedom of the media; with that in mind, condemns the defamation campaign against Iftikhar Mohammad Choudhry, former Chief Justice of Pakistan, as well as the fact that he has been removed from office and placed under house arrest; calls on the Council and the Commission to support the movement for democracy started by the judiciary and the bar, particularly by extending invitations to some of their representatives, including Mr Choudhry; calls for the reinstitution of all deposed judges; notes the adoption of a new Country Strategy Paper for Pakistan and welcomes the mainstreaming of conflict prevention and human rights throughout that document; notes that the first meeting of the European Community-Pakistan Joint Commission was held in Islamabad on 24 May 2007 and stresses the need for human rights to be at the forefront of the agenda for all subsequent meetings;
