By their appeal, Akzo Nobel Chemicals Ltd (‘Akzo’) and Akcros Chemicals Ltd (‘Akcros’) seek to have set aside the judgment of the Court of First Instance of the European Communities (now ‘the General Court’) of 17 September 2007 in Joined Cases T-125/03 and T-253/03 Akzo Nobel Chemicals and Akcros Chemicals v Commission (‘the judgment under appeal’), in so far as it rejected the claim of legal professional privilege for correspondence with Akzo’s in-house lawyer.
Par leur pourvoi, Akzo Nobel Chemicals Ltd (ci-après «Akzo») et Akcros Chemicals Ltd (ci-après «Akcros») demandent l’annulation de l’arrêt du Tribunal de première instance des Communautés européennes du 17 septembre 2007, Akzo Nobel Chemicals et Akcros Chemicals/Commission (T‑125/03 et T-253/03, ci-après l’«arrêt attaqué»), dans la mesure où le Tribunal a rejeté la demande de protection de la confidentialité de la correspondance avec le conseil juridique interne d’Akzo.

– set aside the judgment under appeal in so far as it rejected the claim by Akzo that two e-mails exchanged between Ackros’ general manager and Akzo’s in-house lawyer were not covered by the Community concept of legal professional privilege in view of the employment relationship between that in-house lawyer and Akzo; and
– d’annuler l’arrêt attaqué, dans la mesure où le Tribunal a rejeté le moyen pris par Akzo de l’absence de protection de deux courriels échangés entre le directeur général d’Akcros et l’avocat salarié d’Akzo par le principe de droit communautaire de la protection du secret des communications entre avocat et client, en raison du rapport d’emploi entre cet avocat salarié et Akzo, et
