By their appeal, Akzo Nobel Chemicals Ltd (‘Akzo’) and Akcros Chemicals Ltd (‘Akcros’) seek to have set aside the judgment of the Court of First Instance of the European Communities (now ‘the General Court’) of 17 September 2007 in Joined Cases T-125/03 and T-253/03 Akzo Nobel Chemicals and Akcros Chemicals v Commission (‘the judgment under appeal’), in so far as it rejected the claim of legal professional privilege for correspondence with Akzo’s in-house lawyer.
Par leur pourvoi, Akzo Nobel Chemicals Ltd (ci-après «Akzo») et Akcros Chemicals Ltd (ci-après «Akcros») demandent l’annulation de l’arrêt du Tribunal de première instance des Communautés européennes du 17 septembre 2007, Akzo Nobel Chemicals et Akcros Chemicals/Commission (T‑125/03 et T-253/03, ci-après l’«arrêt attaqué»), dans la mesure où le Tribunal a rejeté la demande de protection de la confidentialité de la correspondance avec le conseil juridique interne d’Akzo.

The actions brought by the appellants before the General Court on 11 April and 4 July 2003 respectively, sought (i) the annulment of Commission Decision C(2003) 559/4 of 10 February 2003, and so far as necessary, of Commission decision C(2003) 85/4 of 30 January 2003 ordering Akzo, Akcros and their respective subsidiaries to submit to an investigation on the basis of Article 14(3) of Regulation No 17 (Case COMP/E-1/38.589) and (ii) an order requiring the Commission to return certain documents seized in the course of the investigation in question and not to use their contents (Case T-125/03) and the annulment of the rejection decision of 8 May 2003 (Case T-253/03).

The Commission increased the fines for Akzo Nobel by 100% and Evonik Degussa by 50% because they had already been fined by the Commission for previous cartels (Akzo Nobel - sodium gluconate - see IP/01/1355 , organic peroxide - see IP/03/1700 , choline chloride - see IP/04/1454 and MCAA - see IP/05/61 ; Evonik Degussa - animal feed - see IP/02/976 ) However, Akzo Nobel received full immunity from fines because it was the first company to come forward with information about the cartel under the Commission's 2002 Leniency Notice.

The Commission will give its consent to this alternative remedy, if it is satisfied that it is equally effective in ensuring the maintenance of the competitive conditions in the aerospace coatings market in the EEA. When Akzo Nobel approaches the Commission with a concrete proposal as to either the identity of a proposed purchaser of the Courtaulds Aerospace Business or as to the concrete details of a proposed sale of Akzo's share in ADAF to Dexter, the Commission will satisfy itself that these proposals are sufficient to ensure that customers will continue to benefit from competition in the markets of concern.
