Draws attention to the complex and unfair situation regarding passenger transport: although domestic passenger transport is taxed in almost all Member States, there are exemptions, zero rates and different rates depending on the mode of transport and the Member State; points out that international maritime and air transport, which includes intra-EU cross-border transport, is exempt from VAT in all Member States, whereas the situation regarding other modes varies across Member States; points out, further, that international air and sea transport providers can purchase some goods and services free of VAT;

In order to facilitate the application of Regulation (EEC) No 1408/71, there should be certain provisions concerning, on the one hand, civil servants and persons treated as such and, on the other, members of the travelling or flying personnel of an undertaking which operates international transport services for passengers or goods by rail, road, air or inland waterway, and also to specify the methods for determining the average amount to take into account in the context of Article 23 of that Regulation.
Pour faciliter l'application du règlement (CEE) no 1408/71, il y a lieu de prévoir certaines dispositions concernant, d'une part, les fonctionnaires ou le personnel assimilé et, d'autre part, le personnel roulant ou navigant d'entreprises de transports internationaux de passagers ou de marchandises par voie ferroviaire, routière, aérienne ou batelière, et également de préciser les modalités de détermination du montant moyen à prendre en compte dans le cadre de l'article 23 dudit règlement.
