According to the Advocate General, that is why the EU legislature took the view that, by contrast with the obligation for the air carrier to pay compensation – which does not apply where the air carrier proves that the cancellation of the flight was the result of extraordinary circumstances which could not have been avoided – the obligation to provide care must remain compelling, whatever the event which resulted in the cancellation and whether or not the air carrier was responsible for that event.
Selon l’avocat général, c’est pour cette raison que le législateur de l’Union a estimé que, contrairement à l’obligation d’indemnisation qui pèse sur le transporteur aérien – laquelle n’est pas due lorsqu’il prouve que l’annulation du vol fait suite à la survenance de circonstances extraordinaires qui n’auraient pas pu être évitées – l’obligation de prise en charge doit perdurer quel que soit l’événement ayant mené à l’annulation et indépendamment d’une éventuelle responsabilité du transporteur aérien.

As regards the financial consequences for air carriers, the Court notes that such consequences may be mitigated, first of all, when an air carrier can prove that the long delay is caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken, that is, circumstances which are beyond the air carrier’s actual control (Wallentin‑Hermann) .

Nonetheless, the Court states that when an air carrier has failed to comply with its obligation to provide care to an air passenger, that passenger may only obtain, by way of compensation, reimbursement of the amounts which proved necessary, appropriate and reasonable to make up for the shortcomings of the air carrier, a matter which is for the national court to assess.
Pour autant, la Cour souligne que lorsque le transporteur aérien n’a pas respecté son obligation de prise en charge d’un passager aérien, ce dernier ne peut obtenir, à titre d’indemnisation, que, le remboursement des sommes qui s’avéraient nécessaires, appropriées et raisonnables afin de suppléer la défaillance du transporteur aérien, ce qu’il appartient à la juridiction nationale d’apprécier.

The air carrier is, however, exempt from its obligation to provide compensation if it is able to prove that the cancellation of the flight was caused by such circumstances.

3. An operating air carrier shall not be obliged to pay compensation in accordance with Article 7, if it can prove that the cancellation is caused by extraordinary circumstances which could not have been avoided even if all reasonable measures had been taken.

The draft Regulation provides for: - governments to appoint traffic coordinators responsible for allocating slots at congested airports; - increased transparency in the allocation of slots among air carriers by making available for consultation all the information on which slot allocation decisions are based; - rules for the allocation of slots at congested airports (2): . creation of pools of available slots, . allocation of at least 50% of the pool to new entrants, . giving up of slots to new entrants (under specific conditions) by certain holders if the pools prove inadequate, . reciprocal allocation of slots when new routes are created.
