In terms of the Republic of Azerbaijan, the Migration Code and other corresponding normative legal acts of the Republic of Azerbaijan applies to all issues not covered by the Agreement, such as the motivation of refusal to issue a visa, the right to appeal against a negative decision or the general rule of the personal interview with the applicant and providing information in relation to the visa application, recognition of travel documents, proof of sufficient means of subsistence, the refusal of entry in the territory of the Republic of Azerbaijan, expulsion measures.

31. Regrets that an unclear vision and hesitation persist on the issue of Azerbaijan’s pursuit of the Association Agreements; stresses the economic potential of EU-Azerbaijan relations, but is concerned by deficiencies in the fields of democracy, the rule of law and human rights in Azerbaijan; insists therefore that Azerbaijan show its commitment by stepping up its relevant standards, including freedom of speech and association and allowing the democratic opposition to enjoy their rights; insists that the release of political prisoners and an end to the harassment of political activists, human rights defenders and journalists are the necessary preconditions for any agreement on a strategic modernisation partnership with Azerbaijan;
31. regrette que la question de l'adhésion par l'Azerbaïdjan aux accords d'association/accords de libre-échange approfondis et complets reste marquée par une vision floue et des atermoiements; souligne le potentiel économique des relations entre l'Union et l'Azerbaïdjan, mais est préoccupé par les lacunes qui subsistent en matière de démocratie, d'état de droit et de droits de l'homme dans ce pays; insiste dès lors sur le fait que l'Azerbaïdjan doit démontrer son engagement en consolidant les normes pertinentes, telles que la liberté d'expression et d'association, et en permettant à l'opposition démocratique de jouir de ses droits; affirme, à cet égard, que la libération des prisonniers politiques et la décision de mettre fin au harcèlement des militants politiques, des défenseurs des droits de l'homme et des journalistes sont des conditions préalables nécessaires à tout accord sur le partenariat stratégique de modernisation avec l'Azerbaïdjan;

E. whereas the Deputy Minister of Justice of the Republic of Azerbaijan, Vilayat Zahirov, sent an official letter to the Ministry of Public Administration and Justice of Hungary on 15 August 2012, in which he stated that the execution of the decisions of foreign states’ courts regarding the transfer of sentenced persons to serve the remaining part of their prison sentences in the Republic of Azerbaijan were carried out in accordance with Article 9(1)(a) of the convention, without any conversion of their sentences; whereas he further gave an assurance that, according to the Criminal Code of the Republic of Azerbaijan, the punishment of a convict serving a life sentence could only be replaced by a court with a term of imprisonment for a specified period, and that the convict could be released on conditional parole only after serving at least 25 years of his or her prison sentence; and whereas the Azerbaijani authorities subsequently denied having given any diplomatic assurances to the Hungarian authorities;
E. considérant que le vice-ministre de la justice de la République d'Azerbaïdjan, Vilayat Zahirov, a adressé le 15 août 2012 une lettre officielle au ministère de l'administration publique et de la justice de Hongrie, dans laquelle il faisait observer qu'il avait été procédé, en conformité avec l'article 9, paragraphe 1 a), de la convention et sans convertir les condamnations, à l'exécution des décisions, prises par des juridictions étrangères, concernant le transfert de personnes condamnées, afin que ces dernières puissent purger le restant de leur peine d'emprisonnement en République d'Azerbaïdjan; qu'il a par ailleurs donné l'assurance que, conformément au code pénal de la République d'Azerbaïdjan, la sanction visant un condamné purgeant une peine de prison à vie ne pouvait être remplacée que par une peine d'emprisonnement d'une durée déterminée fixée par une juridiction, et que le condamné ne pouvait bénéficier d'une liberté conditionnelle qu'après avoir au moins purgé 25 ans de sa peine; que les autorités azerbaïdjanaises ont donc refusé de donner toute assurance diplomatique à leurs homologues hongroises;

7. Recalls its position that the Association Agreement between the EU and Azerbaijan currently being negotiated should include clauses and benchmarks on the protection and promotion of human rights, especially with regard to freedom of the media and the right to freedom of expression, association and assembly, which reflect the principles and rights enshrined in the Constitution of Azerbaijan and commitments made by Azerbaijan in the framework of the Council of Europe and the OSCE;
7. rappelle sa position selon laquelle l'accord d'association entre l'Union européenne et l'Azerbaïdjan actuellement en cours de négociation devrait inclure des clauses et des critères sur la protection et la promotion des droits de l'homme, en particulier eu égard à la liberté des médias et à la liberté d'expression, d'association et de réunion, qui reflètent les principes et les droits inscrits dans la Constitution de l'Azerbaïdjan et les engagements pris par ce pays dans le cadre du Conseil de l'Europe et de l'OSCE;
