This solution, among other things, reflects the point n. 34. of the Report of the European Parliament of 25 November 2011 on modernisation of customs (2011/2083(INI)), that “Calls on the Commission to include in the MCC more rigorous requirements for the provision of the EU’s customs representation services, helping to increase the level of professionalism and ownership on the part of these intermediaries and laying down clear rules to guide relations between customs agents and forwarding undertakings, so as to change the role of the agents to that of consolidators for small and medium-sized importers that do not have the capacity to implement customs compliance programmes similar to those of European AEOs”.

Points to a study commissioned by Parliament on the ‘Implementation of the Modernised Customs Code’ , from which it results that, in the best-case scenario, the entry into force of the MCC (which will be called the Union's Customs Code if the recast proposal by the Commission is adopted) could take place in December 2017; reminds the Commission that the Union has exclusive competence in the area of the customs union and that it should, therefore, ensure compliance by the Member States; calls on the Commission, as a consequence, to step up its efforts to ensure that the MCC is implemented at the earliest possible date, and in any event to avoid the worst-case scenario indicated in the study for March 2033;

32. Deplores the postponement of the entry into force of the Modernised Customs Code (MCC) as provided for in the Commission's proposal for a regulation of the European Parliament and of the Council laying down the Union Customs Code (COM(2012)0064), and considers the proposed new date of 31 December 2020 to be unacceptable; recalls that Regulation (EC) No 450/2008 of the European Parliament and of the Council of 23 April 2008 laying down the Community Customs Code (Modernised Customs Code) provided that the MCC would enter into force by 24 June 2013 and urges the Commission and Member States to take the necessary steps in order to speed up the preparation process;
32. déplore le report de l'entrée en vigueur du Code des douanes modernisé (CDM), ainsi que le prévoit la Commission dans sa proposition de règlement du Parlement européen et du Conseil établissant le code des douanes de l'Union (COM(2012)0064), et juge inacceptable la nouvelle date proposée, à savoir le 31 décembre 2020; rappelle que le règlement (CE) n° 450/2008 du Parlement européen et du Conseil du 23 avril 2008 établissant le code des douanes communautaire (code des douanes modernisé) prévoyait que ce code entrerait en vigueur pour le 24 juin 2013, et exhorte la Commission et les États membres à prendre les mesures nécessaires pour accélérer les préparatifs de cette entrée en vigueur;
