Where, in accordance with the terms of the group financial support agreement, a group entity agrees to provide financial support to another group entity, the agreement may include a reciprocal agreement by the group entity receiving the support to provide financial support to the group entity providing the support.

In accordance with Article 6(7) of the Agreement, several working groups needed to administer the Annexes to the Agreement were set up, including a working group on protection of designations of origin (PDOs) and on protection of geographical indications (PGIs) (Working Group on PDOs and PGIs), and their terms of reference were adopted by Decision No 2/2003 of the Committee (3).

2. A group financial support agreement shall be valid in respect of a group entity only if its shareholders have authorised the management body of that group entity to make a decision that the group entity shall provide or receive financial support in accordance with the terms of the agreement and in accordance with the conditions laid down in this Chapter and that shareholder authorisation has not been revoked.

On 23 February 2009 the Council authorised the Commission to open negotiations with the African, Caribbean and Pacific Group of States with a view to amending, for the second time, the Partnership Agreement between the members of the African, Caribbean and Pacific Group of States, of the one part, and the European Community and its Member States, of the other part, signed in Cotonou on 23 June 2000 , as first amended in Luxembourg on 25 June 2005 , (hereinafter referred to as ‘the Cotonou Agreement’).

Whereas, in order that an improvement may be fostered in the sometimes too dispersed structure of the industry in the road and inland waterway sectors, there should also be exempted from the prohibition on restrictive agreements those agreements, decisions and concerted practices providing for the creation and operation of groupings of undertakings in these two transport sectors whose object is the carrying on of transport operations, including the joint financing or acquisition of transport equipment for the joint operation of services ; whereas such overall exemption can be granted only on condition that the total carrying capacity of a grouping does not exceed a fixed maximum, and that the individual capacity of undertakings belonging to the grouping 1OJ No 205, 11.12.1964, p. 3505/64.
