In order to safeguard Parliament’s position in the case of mixed agreements also, and bearing in mind that, in the majority of cases, mixed agreements address matters which are primarily the competence of the European Union and where the Member States only have residual competence, a similar provision could also be inserted to cover such cases.

(10) This Regulation should be limited to agreements concerning matters related to the fields of jurisdiction, recognition and enforcement of judgments and decisions in matrimonial matters, parental responsibility and maintenance obligations and to the applicable law in matters relating to maintenance obligations.

2. This Regulation shall apply to agreements concerning matters falling, wholly or partly, within the scope of Regulation (EC) No 2201/2003 1 and Regulation (EC) No 4/2009 2 , to the extent that those matters fall within the exclusive competence of the Community.

2. This Regulation shall apply to bilateral agreements between Member States and third countries and closed regional agreements concerning matters falling, entirely or partly, within the scope of Regulation (EC) No 2201/2003 and Regulation (EC) No 4/2009.

Similarly, the new negotiating guidelines should explicitly provide for the inclusion in the agenda for political dialogue of the new association agreement of matters relating to the common European security and defence policy, together with the proposals relating thereto set out in the resolution of the European Parliament of 16 January 1997 on the Communication from the Commission to the Council and the European Parliament on “The European Union and Latin America: the present situation and prospects for closer partnership 1996-2000” (COM(95) 495 - C4-0489/95 ) and the conclusions of the various Mercosur/EU seminars on security and defence matters organised by IRELA in recent years;
