In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 on the Financial Regulation applicable to the general budget of the European Communities (1) and the Financial Regulation adopted by the Management Board of the Agency on 26 March 2003, with Commission Regulation (EC, Euratom) No 2343/2002 of 19 November 2002 on the framework Financial Regulation for the bodies referred to in Article 185 of Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities (2) and with the other instruments referred to in this Decision, contracts or agreements concluded and decisions taken with beneficiaries established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the beneficiaries and of their subcontractors by Agency and Commission officials or by other persons mandated by the Agency and the Commission.

Conformément au règlement (CE, Euratom) no 1605/2002 du Conseil du 25 juin 2002 portant règlement financier applicable au budget général des Communautés européennes (1) et au règlement financier adopté par le conseil d'administration de l'Agence le 26 mars 2003, au règlement (CE, Euratom) no 2343/2002 de la Commission du 19 novembre 2002 portant règlement financier-cadre des organismes visés à l'article 185 du règlement (CE, Euratom) no 1605/2002 du Conseil portant règlement financier applicable au budget général des Communautés européennes (2), ainsi qu'aux autres réglementations auxquelles se réfère la présente décision, les contrats ou conventions conclus ainsi que les décisions prises avec des bénéficiaires établis en Suisse peuvent prévoir que des audits scientifiques, financiers, technologiques ou autres peuvent être effectués à tout moment auprès d'eux et de leurs sous-traitants par des agents de l'Agence et de la Commission ou par d'autres personnes mandatées par celles-ci.

The Court wishes to draw the attention of the Parliament and Council to four matters not brought to their attention in the Commission’s explanatory memorandum: the clearing of prefinancing payments (Article 81), the responsibilities of the accounting officer (Article 123), the audit of agencies (Article 185(4)) and the proliferation of reporting obligations across the Financial Regulation.
La Cour souhaite attirer l’attention du Parlement et du Conseil sur quatre questions qui ne sont pas portées à leur attention dans l’exposé des motifs de la Commission: l’apurement des paiements de préfinancement (article 81), les responsabilités du comptable (article 123), le contrôle des agences de l’UE (article 185, paragraphe 4) et la prolifération des obligations de rendre compte dans l’ensemble du règlement financier.

Aim: To ensure that all staff (permanent, temporary, agency staff, drivers) with access to identifiable air cargo/air mail have been subject to an appropriate pre-employment check and/or background check as well as trained in accordance with point 11.2.7 of the Annex to Regulation (EU) No 185/2010. In addition, to ensure that all staff implementing security controls in respect of supplies are trained in accordance with chapter 11 of the Annex to Regulation (EU) No 185/2010.

Notes that the Agency was financed in 2008 by a Community subsidy of EUR 62 200 000 in accordance with Article 185 of the Financial Regulation, and, to a minor extent, by fees paid by industry for registrations of chemical substances in accordance with the REACH Regulation (Regulation (EC) No 1907/2006 of the European Parliament and the Council of 18 December 2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH), establishing a European Chemicals Agency );

Although Parliament was unable to achieve its demand that, for reasons of transparency and accountability, all agencies that act on behalf of the Union, irrespective of whether they receive grants charged to the budget, should be subject to the framework financial regulation, the strong position of the Commission's internal auditor vis-à-vis the agencies was, at least, maintained (Article 185(3) of the FR).

They may not depart from Commission Regulation (EC, Euratom) No 2343/2002 (12) on the framework Financial Regulation for the bodies referred to in Article 185 of the general Financial Regulation, unless specifically required for the Agency’s operation and with the Commission’s prior consent.
