The European Commission has today decided to move forward on the infringement procedure against Hungary concerning its asylum legislation by sending a complementary letter of formal notice.
La Commission a décidé aujourd'hui de poursuivre le cours de la procédure d'infraction à l'encontre de la Hongrie en ce qui concerne la législation de cette dernière en matière d'asile, en lui adressant une lettre de mise en demeure complémentaire.

Recalls the role of the Commission as guardian of the Treaties in ensuring that national legislation is in conformity with democracy, the rule of law and fundamental rights; stresses the importance of any evaluation and analysis carried out by the Commission and the Parliament as to the situation in individual Member States being fact-based and objective; invites the Hungarian Government and the Commission to work closely and cooperatively together on any issues which they feel may require further evaluation or analysis; notes with satisfaction the opening of the infringement procedure against Hungary concerning asylum acquis ;

G. whereas in July and September 2015 the Hungarian Parliament adopted a number of amendments, relating in particular to the law on asylum, the penal code, the law on criminal procedure, the law on the border, the law on the police and the law on national defence; whereas the Commission’s preliminary assessment revealed a number of serious concerns and questions regarding compatibility with the asylum and borders acquis and the Charter of Fundamental Rights; whereas on 6 October 2015 the Commission sent an administrative letter to the Hungarian Government; whereas the Hungarian Government responded to that letter; whereas on 10 December 2015 the Commission opened an infringement procedure against Hungary;
G. considérant qu'en juillet et en septembre 2015, le Parlement hongrois a adopté plusieurs amendements portant notamment sur la loi régissant les conditions d'asile, sur le code pénal, sur le code de procédure pénal, sur la loi de protection des frontières, sur le code de police et sur la loi sur la défense nationale; considérant que l'évaluation préliminaire de la Commission a suscité un certain nombre de préoccupations et de questions graves portant sur la compatibilité avec l'acquis en matière d'asile et la charte des droits fondamentaux; que, le 6 octobre 2015, la Commission a adressé une lettre administrative au gouvernement hongrois; que le gouvernement hongrois a répondu à ce courrier; que, le 10 décembre 2015, la Commission a ouvert une procédure d'infraction à l'encontre de la Hongrie;
