Whereas it is true that in the Tobacco Advertising case the Court of Justice held that Article 95(1) cannot be construed as vesting in the Community legislature a general power to regulate the internal market, it is submitted in the first place that the object of the proposed measure is to improve the conditions for the establishment and functioning of the internal market and, in any event, that in assessing the appropriateness of a given legal basis, the decisive factor should be the main object of the measure in question.
S'il est exact que, dans l'affaire relative à la publicité pour le tabac, la Cour de justice a indiqué que l'article 95, paragraphe 1, ne pouvait être interprété comme prévoyant, dans la législation communautaire, un pouvoir général de réglementer le marché intérieur, il est à noter en premier lieu que la mesure proposée à pour objet d'améliorer les conditions d'établissement et de fonctionnement du marché intérieur et, en tout état de cause, que dans l'évaluation du caractère approprié d'une base juridique, l'élément déterminant doit être constitué par l'objet principal de la mesure en question.
