In the assessment of the existence of an advantage, the Commission will first demonstrate that the measure could not be obtained from the rest of the market. Secondly, it will demonstrate that SACE did not act as a private reinsurer. Third, it will demonstrate that even when one takes into account the fact that SACE was the parent company of SACE BT, this does not allow to conclude that SACE acted as a private company in such a situation would have done. Fourth, the Commission will demonstrate that the reinsurance provided by SACE provides an advantage to SACE BT.
Aux fins de son appréciation de l'existence d'un avantage, la Commission démontrera: en premier lieu, que les autres opérateurs du marché n'auraient pas pu avoir accès à la mesure en cause; en second lieu, que SACE n'a pas agi au même titre qu'un réassureur privé; en troisième lieu, que le fait que SACE soit la société mère de SACE BT ne permet nullement d'en conclure que SACE a agi comme une entreprise privée l'aurait fait dans une situation analogue; en quatrième lieu, que la couverture de réassurance fournie par SACE a conféré un avantage à SACE BT.

The Commission finds that the initial capital allocation of EUR 100 million in the form of share capital and the capital contribution into reserves (so-called ‘Fondo di organizzazione’) in the amount of EUR 5,8 million by SACE for the establishment of SACE BT in 2004 (first measure) did not confer an advantage to SACE BT and thus do not constitute State aid within the meaning of Article 107(1) of the Treaty.
La Commission constate que la dotation en capital initial de 100 millions d'EUR, sous forme de capital social, et l'apport en capital au fonds de réserve (communément dénommé «fondo di organizzazione») pour un montant de 5,8 millions d'EUR, effectués par SACE aux fins de la constitution de SACE BT en 2004 (première mesure), n'ont pas conféré d'avantages à SACE BT et ne constituent donc pas une aide d'État au sens de l'article 107, paragraphe 1, du TFUE.

Finally, as regards the question whether the reinsurance provided an advantage to SACE BT, as acknowledged by SACE (see recital 70), the measure allowed SACE BT to increase its credit insurance provision capacity and hence allowed it to subscribe more contracts than it would have been able to do otherwise.

The Commission concludes that the second measure provided an advantage to SACE BT corresponding to the difference between the fee actually paid by SACE BT and that, at least 10 % higher, that a private reinsurer would have requested taking into consideration the higher level of risk assumed.

As regards the second measure, based on the information provided by the Italian authorities illustrating the difficulties to find the reinsurance cover on the market, the Commission raised doubts whether the second measure has not conferred an advantage to SACE BT.
Eu égard à la deuxième mesure, la Commission — se fondant sur les informations communiquées par les autorités italiennes, qui illustrent les difficultés de la société à trouver sur le marché des opérateurs disposés à lui fournir la couverture de réassurance requise — a exprimé des doutes sur l'absence d'avantage conféré à SACE BT par la deuxième mesure.

However, for additional capital injections in 2009 to cover losses and a reinsurance cover in favour of SACE BT, totalling €70.2 million, the state-owned parent entity did not take into consideration the risk profile of the investment and therefore did not behave as a market economy investor would have, giving SACE BT an undue economic advantage.
En revanche, pour les autres injections de capital réalisées en 2009 pour couvrir les pertes, ainsi que la couverture de réassurance en faveur de SACE BT, pour un total de 70,2 millions d’euros, l’entité mère publique n’a pas pris en considération le profil de risque de l’investissement et, partant, n’a pas agi conformément au principe de l’investisseur privé opérant dans une économie de marché, ce qui a procuré à SACE BT un avantage économique indu.

It is, therefore, important that a healthy competition, beneficial for the European export industry as a whole, is not distorted by State subsidies," said Joaquín Almunia Commission Vice-President in charge of competition policy, adding: "We need to ascertain that Ducroire and SACE BT have not received an unfair economic advantage over their competitors".
