Application of the system of import and export licences and advance fixing certificates for agricultural products.

Whereas Article 4 of Council Regulation No 142/67/EEC (4) of 21 June 1967 on export refunds on colza, rape and sunflower seeds, as last amended by Regulation (EEC) No 845/68, (5) provides for the possibility of the export refund on seeds being fixed in advance ; whereas, in the interests of sound administration, advance fixing certificates should be introduced, coupled with the lodging of a deposit guaranteeing that exportation will be effected during the period of validity of the certificate ; whereas, for the same reason, exports benefiting from the advance fixing arrangements must be effected during the period of validity of the certificate;
considérant que l'article 4 du règlement nº 142/67/CEE du Conseil, du 21 juin 1967, relatif aux restitutions à l'exportation des graines de colza, de navette et de tournesol (4), modifié en dernier lieu par le règlement (CEE) nº 845/68 (5), prévoit la possibilité de fixer à l'avance la restitution à l'exportation des graines ; que, dans l'intérêt d'une bonne administration, il convient d'instaurer des certificats de préfixation assortis de la constitution d'une caution garantissant l'engagement d'exporter pendant la durée de validité du certificat ; que pour le même motif il est nécessaire que l'exportation bénéficiant du régime de préfixation ait lieu pendant la durée de validité du certificat,

( B ) WHERE PRODUCTION OF AN EXPORT LICENCE OR ADVANCE FIXING CERTIFICATE IS OPTIONAL FOR EXPORTATION AND WHERE THE RATE OF REFUND ON THE PRODUCTS EXPORTED HAS NOT BEEN FIXED IN ADVANCE , THE TIME LIMIT LAID DOWN IN THE PRECEDING SUBPARAGRAPH SHALL BE EQUAL TO THE PERIOD OF VALIDITY OF THE EXPORT LICENCE OR ADVANCE FIXING CERTIFICATE APPLICABLE TO PRODUCTS OF THE SAME KIND .
B ) LORSQUE LA PRODUCTION D'UN CERTIFICAT D'EXPORTATION OU DE PREFIXATION EST FACULTATIVE POUR L'EXPORTATION ET QUE LES PRODUITS POUR LESQUELS LA RESTITUTION EST ACCORDEE NE SONT PAS EXPORTES AU BENEFICE D'UN REGIME DE FIXATION A L'AVANCE DU TAUX DE LA RESTITUTION, LE DELAI VISE A L'ALINEA PRECEDENT EST EGAL A LA DUREE DE VALIDITE DES CERTIFICATS D'EXPORTATION OU DE PREFIXATION APPLICABLE AUX PRODUITS DE MEME ESPECE .
