IN-CONTEXT TRANSLATIONS

The proposal seeks to align Council Regulation (EC) No 812/2004 with the provisions of the Treaty on the Functioning of the European Union (‘the Treaty’), which makes a distinction between the powers delegated to the Commission to adopt non-legislative acts of general application to supplement or amend certain non-essential elements of the legislative act as laid down in Article 290(1) of the Treaty (delegated acts), and the powers conferred upon the Commission to adopt uniform conditions for implementing legally binding Union acts as laid down in Article 291(2) of the Treaty (implementing acts).
La proposition vise à aligner le règlement (CE) no 812/2004 du Conseil sur les dispositions du traité sur le fonctionnement de l'Union européenne (ci-après le «TFUE»), qui établit une distinction entre, d'une part, les compétences déléguées à la Commission lui permettant d'adopter des actes non législatifs de portée générale qui complètent ou modifient certains éléments non essentiels d'un acte législatif, comme le prévoit l'article 290, paragraphe 1, du TFUE (actes délégués), et, d'autre part, les compétences conférées à la Commission lui permettant d'adopter des règles uniformes d'exécution d'actes juridiquement contraignants de l'Union, comme le prévoit l'article 291, paragraphe 2, du TFUE (actes d'exécution).

The power to adopt recommendations on the adoption of precautionary corrective measures and on the preparation of a macroeconomic adjustment programme; the power to approve macroeconomic adjustment programmes; the power to adopt decisions on the main policy requirements which the ESM or the EFSF plan to include in the conditionality for financial assistance granted on a precautionary basis, loans for the recapitalisation of financial institutions or any new financial instrument agreed within the framework of the ESM; and the power to recommend the adoption of corrective measures to Member States under post-programme surveillance, should be conferred on the Council.

The Management Board should be entrusted with the necessary powers, inter alia, to propose the annual and multi-annual work programme, to exercise certain budgetary powers, to adopt the Authority’s staff policy plan, to adopt special provisions on the right to access to documents and to propose the annual report.

(9) the second purpose of this Decision is to simplify the requirements for the exercise of implementing powers conferred on the Commission as well as to improve the involvement of the European Parliament in those cases where the basic instrument conferring implementation powers on the Commission was adopted in accordance with the procedure laid down in Article 251 of the Treaty; it has been accordingly considered appropriate to reduce the number of procedures as well as to adjust them in line with the respective powers of the institutions involved and notably to give the European Parliament an opportunity to have its views taken into consideration by, respectively, the Commission or the Council in cases where it considers that, respectively, a draft measure submitted to a committee or a proposal submitted to the Council under the regulatory procedure exceeds the implementing powers provided for in the basic instrument;
