TRADUCTIONS EN CONTEXTE

In order to supplement and amend certain non-essential elements of this Regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of the identification of the period of time and of the relevant starting or ending dates of the period of time with regard to the admissibility criteria of applications, adjusting the percentages concerning the indicative distribution of funds among the objectives under direct management, the definition of eligible operations and costs for hygiene, health and safety-related investments and investments concerning working conditions, on board or in individual equipment, the definition of eligible costs of operations to protect and restore marine biodiversity and ecosystems in the framework of sustainable fishing activities, the definition of costs eligible for support with regard to investments in equipment or on board aimed at reducing the emission of pollutants or green-house gases and increasing the energy efficiency of fishing vessels, the definition of the criteria for calculation of the additional costs resulting from the specific handicaps of outermost regions, the definition of the cases of non-compliance by Member States which can trigger interruption of the payment deadline or suspension of payments, the definition of the criteria for establishing the level of financial correction to be applied and the criteria for applying flat rates or extrapolated financial corrections and the definition of the content and construction of the common monitoring and evaluation system.
Afin de compléter et de modifier certains éléments non essentiels du présent règlement, il convient de déléguer à la Commission le pouvoir d’adopter des actes conformément à l’article 290 du traité sur le fonctionnement de l’Union européenne en ce qui concerne la détermination de la période et de la date de début ou de fin pertinente de la période en rapport avec les critères d’admissibilité des demandes, en ajustant les pourcentages concernant la répartition indicative des fonds entre les objectifs relevant de la gestion directe, la définition des opérations éligibles et les coûts associés aux investissements en matière d’hygiène, de santé et de sécurité concernant les conditions de travail, à bord ou pour les équipements individuels, la définition des coûts éligibles liés aux opérations visant à protéger et à rétablir la biodiversité et les écosystèmes marins dans le cadre d’activités de pêche durables, la définition de coûts éligibles au soutien en ce qui concerne les investissements en matière d’équipements ou à bord visant à réduire l’émission de polluants ou de gaz à effet de serre et à augmenter l’efficacité énergétique des navires de pêche, la définition des critères de calcul des coûts supplémentaires résultant des handicaps spécifiques des régions ultrapériphériques, la définition des cas de manquement par les États membres qui peuvent entraîner l’interruption du délai de paiement ou la suspension des paiements, la définition des critères de détermination du niveau de correction financière à appliquer et des critères relatifs à l’application de corrections financières forfaitaires ou extrapolées, et la définition du contenu et de la construction d’un cadre commun pour le système de suivi et d’évaluation.

6. The Commission shall be empowered to adopt delegated acts in accordance with Article 38 to further specify how insurance intermediaries and insurance undertakings are to comply with the principles set out in this Article when carrying out insurance distribution activities with their customers, including with regard to the information to be obtained when assessing the suitability and appropriateness of insurance-based investment products for their customers, the criteria to assess non-complex insurance-based investment products for the purposes of point (ii) of point (a) of paragraph 3 of this Article, and the content and format of records and agreements for the provision of services to customers and of periodic reports to customers on the services provided.
6. La Commission est habilitée à adopter des actes délégués, en conformité avec l’article 38, pour préciser plus avant comment les intermédiaires et entreprises d’assurance doivent se conformer aux principes énoncés dans le présent article lorsqu’ils ou elles exercent des activités de distribution d’assurances avec leurs clients, y compris en ce qui concerne les informations à obtenir lors de l’évaluation de l’adéquation et du caractère approprié des produits d’investissement fondés sur l’assurance pour leurs clients, les critères pour évaluer les produits d’investissement non complexes fondés sur l’assurance aux fins du paragraphe 3, point a) ii), du présent article et le contenu et le format des enregistrements et des accords pour la fourniture de services aux clients et des rapports périodiques aux clients sur les services fournis.

For the purposes of the food distribution scheme provided for in the first subparagraph “most deprived persons” means physical persons, including families or groups composed of such persons, who are recorded or recognised on the basis of eligibility criteria adopted by the national competent authorities to be socially and financially dependent, or who are judged to be so on the basis of the criteria used by the designated organisations and approved by those national competent authorities.
Aux fins du régime de distribution de denrées alimentaires prévu au premier alinéa, on entend par “personnes les plus démunies”, des personnes physiques, y compris les familles ou groupements composés de ces personnes, dont la situation de dépendance sociale et financière est constatée ou reconnue sur la base de critères d’éligibilité adoptés par les autorités nationales compétentes, ou est établie au regard des critères appliqués par les organismes désignés et approuvés par ces autorités nationales compétentes.

9. Notes the additional allocation of eligible areas for designation as having the status of areas within the scope of Article 87(3)(c) of the Treaty according to the country ceilings determined by the Commission, which also takes into account variations in unemployment between the regions; as regards the total population ceiling, calls nonetheless on the Commission to adopt distribution criteria which take into consideration the relative disadvantages of certain Member States so as not to impose stiff penalties on the ones which still display significant and objective internal differences due in part to the existence of underdeveloped regions with the status of Article 87(3)(a) of the Treaty areas; calls, therefore, for adoption of the same distribution criteria and the same correctives laid down in the current guidelines and for authorisation of the requisite modest increase in the total 25-Member EU population ceiling which is eligible for regional aid;
9. prend acte de l'attribution supplémentaire de zones éligibles au statut de région relevant de l'article 87, paragraphe 3, point c), du traité selon les plafonds nationaux établis par la Commission, qui tient également compte des disparités régionales en termes de chômage; en ce qui concerne le plafond total de population, invite toutefois la Commission à adopter des critères de répartition qui prennent en considération les désavantages relatifs de certains États membres, de manière à ne pas pénaliser sévèrement ceux qui présentent encore des différences internes significatives et objectives, du fait en partie de l'existence de régions en retard de développement bénéficiant du statut des régions relevant de l'article 87, paragraphe 3, point a), du traité; demande dès lors que l'on adopte les mêmes critères de répartition et les mêmes correctifs que ceux qui sont prévus dans les lignes directrices actuellement en vigueur, et que l'on autorise l'augmentation modeste nécessaire du plafond total de population de l'UE à 25 États membres éligible aux aides à finalité régionale;

A foreign person or a company in which foreign participation ensures a majority in adopting decisions or blocks the adoption of decisions, directly or through other companies with foreign participation, is to obtain a permission for: (i)distribution of weapons, munitions or military equipment; (ii)banking or insurance activities, or participation in banking or insurance companies; (iii)prospecting, development or extraction of natural resources from the territorial sea, continental shelf or the exclusive economic zone; (iv)acquisition of participation which ensures a majority in adopting decisions or blocks the adoption of decisions in a company engaged in any of the activities specified in (i), (ii) and (iii) above.With respect to banking and insurance referred to in (ii) and (iv), the criteria for authorisation or permission are prudential and are consistent with the obligation of Articles XVI and XVII of the GATS.
Une personne étrangère ou une société dans laquelle la participation étrangère assure une majorité lors du processus décisionnel ou bloque celui-ci, directement ou par l'intermédiaire d'autres sociétés à participation étrangère, doit obtenir une autorisation pour: i)la distribution d'armes, de munitions ou de matériel militaire; ii)l'exercice d'activités d'assurance et de banque ou la participation dans des établissements bancaires ou des compagnies d'assurances; iii)la prospection, le développement ou l'extraction de ressources naturelles dans les eaux territoriales, le plateau continental ou la zone économique exclusive; iv)la prise de participation qui assure une majorité lors du processus décisionnel ou bloque celui-ci dans des sociétés exerçant l'une ou l'autre activité mentionnée aux points i), ii) et iii) ci-dessus.Pour ce qui est des activités d'assurance et de banque visées aux points ii) et iv), les critères d'octroi de l'autorisation ou de la permission sont prudentiels et conformes aux obligations des articles XVI et XVII de l'AGCS.

2. Member States shall inform the Commission each year of the criteria they have adopted for distribution and of the detailed rules for the use the fishing availabilities allocated to them, in accordance with Community law and the common fisheries policy.
2. Chaque année, les États membres informent la Commission des critères qu'ils ont adoptés pour la répartition des disponibilités de pêche qui leur ont été allouées et pour les modalités de leur utilisation, conformément au droit communautaire et à la politique commune de la pêche.
