In its Resolution of 15 January 2013 the European Parliament called for the adoption of a regulation on a European Law of Administrative Procedure to guarantee the right to good administration by means of an open, efficient and independent European administration.

Several successive programmes have sought to ensure the coherent development and implementation of global and sectoral interoperability strategies, legal frameworks, guidelines, services and tools to address requirements under Union-wide policies, such as: (i) the programme for the interchange of data between administrations (1999-2004) (the ‘IDA programme’), established by Decisions No 1719/1999/EC (23) and No 1720/1999/EC (24) of the European Parliament and of the Council; (ii) the programme for interoperable delivery of pan-European eGovernment services to public administrations, businesses and citizens (2005-2009) (the ‘IDABC programme’), established by Decision 2004/387/EC of the European Parliament and of the Council (25); and (iii) the programme on interoperability solutions for European public administrations (2010-2015) (the ‘ISA programme’), established by Decision No 922/2009/EC of the European Parliament and of the Council (26).
Plusieurs programmes successifs ont eu pour objectif d'assurer l'élaboration et la mise en œuvre cohérentes, au niveau global et sectoriel, de stratégies, de cadres juridiques, d'orientations, de services et d'outils en matière d'interopérabilité, qui répondent aux exigences des politiques à l'échelle de l'Union, tels que: i) le programme pour l'échange électronique de données entre administrations (1999-2004) (ci-après dénommé «programme IDA»), institué par les décisions du Parlement européen et du Conseil no 1719/1999/CE (23) et no 1720/1999/CE (24); ii) le programme pour la fourniture interopérable de services paneuropéens d'administration en ligne aux administrations publiques, aux entreprises et aux citoyens (2005-2009) (ci-après dénommé «programme IDABC»), institué par la décision 2004/387/CE du Parlement européen et du Conseil (25); et iii) le programme pour des solutions d'interopérabilité pour les administrations publiques européennes (2010-2015) (ci-après dénommé «programme ISA»), institué par la décision no 922/2009/CE du Parlement européen et du Conseil (26).

In particular, rules should be established to supplement certain non-essential elements of Regulation (EU) No 1306/2013 in relation to the functioning of the integrated administration and control system (integrated system), the time limits for the submission of aid applications or payment claims, the conditions for the partial or total refusal of aid and the partial or total withdrawal of undue aid or support and the determination of administrative penalties to deal with non-compliances related to conditions for receiving aid under schemes established by Regulation (EU) No 1307/2013 of the European Parliament and of the Council and conditions for receiving support under rural development measures established by Regulation (EU) No 1305/2013 of the European Parliament and of the Council , and rules on the maintenance of permanent pasture and calculation of administrative penalties as regards the cross-compliance obligations.

Regulation (EU) No 912/2010 should be aligned with the principles contained in the common approach of the European Parliament, the Council and of the Commission to the decentralised agencies, adopted by the three institutions on 5 July, 26 June and 12 June 2012 respectively, particularly with regard to the rules for adopting decisions of the Administrative Board, the terms of office of the members of the Administrative Board and of the Security Accreditation Board and those of their chairpersons, the existence of a multiannual work programme, the powers of the Administrative Board concerning staff management, assessment and revision of that Regulation, prevention and management of conflicts of interest and handling of non-classified but sensitive information.

This action underpins EU efforts in the area of tobacco control and supports the implementation of Directive 2001/37/EC of the European Parliament and of the Council of 5 June 2001 on the approximation of the laws, regulations and administrative provisions of the Member States concerning the manufacture, presentation and sale of tobacco products (47), Directive 2003/33/EC of the European Parliament and of the Council of 26 May 2003 on the approximation of the laws, regulations and administrative provisions of the Member States relating to the advertising and sponsorship of tobacco products (48), Directive 2010/13/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (49) and Council Recommendation 2003/54/EC of 2 December 2002 on the prevention of smoking and on initiatives to improve tobacco control (50).

(9) The CECIS should be set up on the basis of a global implementation plan (GIP) as part of the PROCIV-NET project conducted and financed in the context of a programme for the interchange of data between administrations, the IDA programme as provided for in Decision No 1719/1999/EC of the European Parliament and the Council of 12 July 1999 on a series of guidelines, including the identification of projects of common interest, for trans-European networks for the electronic interchange of data between administrations (IDA)(4), as last amended by Decision No 2046/2002/EC(5), and Decision No 1720/1999/EC of the European Parliament and of the Council of 12 July 1999 adopting a series of actions and measures in order to ensure interoperability of and access to trans-European networks for the electronic interchange of data between administrations (IDA)(6), as last amended by Decision No 2045/2002/EC(7).
