(9) This Regulation constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.
(9) Conformément au protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne, le présent règlement constitue un développement de l'acquis de Schengen, tel que défini par l'annexe A de la décision 1999/435/CE du Conseil du 20 mai 1999 relative à la définition de l'acquis de Schengen en vue de déterminer, conformément aux dispositions pertinentes du traité instituant la Communauté européenne et du traité sur l'Union européenne, la base juridique de chacune des dispositions ou décisions qui constituent l'acquis.

(12) This instrument constitutes a development of the Schengen acquis, in accordance with the Protocol integrating the Schengen acquis into the framework of the European Union, as defined in Annex A to Council Decision 1999/435/EC of 20 May 1999 concerning the definition of the Schengen acquis for the purpose of determining, in conformity with the relevant provisions of the Treaty establishing the European Community and the Treaty on European Union, the legal basis for each of the provisions or decisions which constitute the acquis.

An essential part of the observance of the application of the rules of the Schengen acquis, which form part of European law, is the evaluation mechanism, which should guarantee the transparent, efficient and consistent implementation of the Schengen acquis, and also reflect the changes to the legislative situation which came into being after the integration of the Schengen acquis into the EU framework.

G. whereas, given that the existing consumer protection acquis is a distinctive area of Community law which reflects the EC legislature's concern to deliver a high level of consumer protection in accordance with the Treaties, and although it is clear that the European contract law initiative has a wider remit of securing and developing the coherence of contract law as a whole, this exercise should not lead to a dilution of the values at the heart of the existing consumer protection acquis,

As regards Switzerland, this Decision constitutes a development of the Schengen acquis within the meaning of the Agreement signed by the European Union, the European Community and the Swiss Confederation on the latter’s association with the implementation, application and development of the Schengen acquis, which fall within the area referred to in Article 4(1) of Council Decision 2004/860/EC of 25 October 2004 on the signing, on behalf of the European Community, and on the provisional application of certain provisions of the Agreement between the European Union, the European Community and the Swiss Confederation, concerning the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis

The United Kingdom is taking part in this Decision, in accordance with Article 5 of the Protocol integrating the Schengen acquis into the framework of the European Union annexed to the Treaty on European Union and to the Treaty establishing the European Community and Article 8(2) of Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis , to the extent that its measures develop provisions of the Schengen acquis against the organisation of illegal immigration in which the United Kingdom participates, and the Protocol on the position of the United Kingdom and Ireland annexed to the Treaty on European Union and to the Treaty establishing the European Community, having notified under Article 3 thereof its wish to take part in the adoption and application of this Decision.
Le Royaume-Uni participe à la présente décision, conformément à l'article 5 du protocole intégrant l'acquis de Schengen dans le cadre de l'Union européenne et à l'article 8, paragraphe 2, de la décision 2000/365/CE du Conseil du 29 mai 2000 relative à la demande du Royaume-Uni de Grande-Bretagne et d'Irlande du Nord de participer à certaines dispositions de l'acquis de Schengen , pour autant que ses mesures développent les dispositions de l'acquis de Schengen afin de lutter contre l'organisation de l'immigration illégale auxquelles le Royaume-Uni participe, et conformément à l'article 3 du protocole sur la position du Royaume-Uni et de l'Irlande annexé au traité sur l'Union européenne et au traité instituant la Communauté européenne, ayant notifié son souhait de participer à l'adoption et à l'application de la présente décision.

As regards Switzerland, except insofar as it establishes an exchange of information on the problems associated with the return of third-country nationals other than those who do not fulfil or who no longer fulfil the conditions for a short stay applicable within the territory of a Member State by virtue of the provisions of the Schengen acquis, this Decision constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement signed between the European Union, the European Community and the Swiss Confederation concerning the implementation, application and development of the Schengen acquis , which fall within the areas referred to in Article 1, points A, B, C and E of Decision 1999/437/EC read in conjunction with Article 4(1) of Council Decision 2004/849/EC of 25 October 2004 and of Council Decision 2004/860/EC of 25 October 2004 on the signing of that Agreement on behalf of the European Union and the European Community, respectively, and on the provisional application of certain provisions thereof.
En ce qui concerne la Suisse, et sauf dans la mesure où elle instaure un échange d'informations sur les problèmes associés au retour des ressortissants de pays tiers autres que ceux qui ne remplissent pas ou ne remplissent plus les conditions prévues pour bénéficier d'un court séjour, applicables sur le territoire d'un État membre en vertu des dispositions de l'acquis de Schengen, la présente décision constitue un développement des dispositions de l'acquis de Schengen au sens de l'accord signé entre l'Union européenne, la Communauté européenne et la Confédération suisse sur l'association de la Confédération suisse à la mise en œuvre, à l'application et au développement de l'acquis de Schengen , qui relèvent des domaines visés à l'article 1er, points A), B), C) et E), de la décision 1999/437/CE lu en liaison avec l'article 4, paragraphe 1, des décisions 2004/849/CE du Conseil du 25 octobre 2004 et 2004/860/CE du Conseil du 25 octobre 2004 relatives à la signature, au nom de l'Union européenne de la Communauté européenne, respectivement, et à l'application provisoire de certaines dispositions dudit accord.
