(2) For the purposes of this Part, if a registrant acquires, imports or brings into a participating province tangible personal property that is to be incorporated into or to form a constituent or component part of tangible personal property manufactured or produced in Canada by the registrant, the registrant is deemed to have acquired or imported the property, or brought it into a participating province, as the case may be, for the purpose of supply by way of sale.

David Anderson (for the Finance Minister) moved: Motion No. 60 That Bill C-70, in Clause 203, be amended by adding after line 20 on page 231 the following: ``(3) Subsection (1) does not apply to (a) an imported taxable supply of intangible personal property or a service made to a person who is resident in the Nova Scotia offshore area or the Newfoundland offshore area unless the property or service is acquired by the person for consumption, use or supply in the course of an offshore activity or the person is also resident in a participating province that is not an offshore area; or (b) an imported taxable supply of tangible personal property the physical possession of which is transferred, or that is delivered or made available, to the recipient of the supply in the Nova Scotia offshore area or the Newfoundland offshore area unless the property is acquired by the recipient for consumption, use or supply in the course of an offshore activity (4) For the purposes of subsection (1), a person that acquires property or a service for consumption, use or supply in the Nova Scotia offshore area or the Newfoundland offshore area is deemed to acquire the property or service for consumption, use or supply in that area only to the extent that it is acquired for consumption, use or supply in that area in the course of an offshore activity'.

David Anderson (au nom du ministre des Finances) propose: Motion no 60 Que le projet de loi C-70, à l'article 203, soit modifié par adjonction, après la ligne 21, page 231, de ce qui suit: «(3) Le paragraphe (1) ne s'applique pas aux fournitures suivantes: a) la fourniture taxable importée d'un bien meuble incorporel ou d'un service effectuée au profit d'une personne qui réside dans la zone extracôtière de la Nouvelle-Écosse ou la zone extracôtière de Terre-Neuve, sauf si la personne acquiert le bien ou le service pour consommation, utilisation ou fourniture dans le cadre d'une activité extracôtière ou si elle réside également dans une province participante qui n'est pas une zone extracôtière; b) la fourniture taxable importée d'un bien meuble corporel qui est livré à l'acquéreur dans la zone extracôtière de la Nouvelle-Écosse ou la zone extracôtière de Terre-Neuve ou y est mis à sa disposition, ou dont la possession matérielle l'y est transférée, sauf si l'acquéreur acquiert le bien pour consommation, utilisation ou fourniture dans le cadre d'une activité extracôtière (4) Pour l'application du paragraphe (1), la personne qui acquiert un bien ou un service pour consommation, utilisation ou fourniture dans la zone extracôtière de la Nouvelle-Écosse ou la zone extracôtière de Terre-Neuve est réputée l'acquérir pour consommation, utilisation ou fourniture dans cette zone seulement dans la mesure où il est acquis pour consommation, utilisation ou fourniture dans cette zone dans le cadre d'une activité extracôtière».
