If the group level resolution authority, after consultation with the other resolution authorities in accordance with paragraph 2, assesses that the failure of the institution in question, or the resolution action or other measures notified in accordance with point (b) of paragraph 1, would not have a detrimental impact on the group or on affiliated institutions in other Member States, the resolution authority responsible for that institutionmay take the resolution action or other measures that it notified in accordance in accordance with point (b) of paragraph 1.

Where a member of the general public intends to introduce a restricted explosives precursor into the territory of a Member State which has derogated from paragraph 1 by applying a licensing regime in accordance with paragraph 2 and/or a registration regime in accordance with paragraph 3 or with Article 17, that person shall obtain, and, if requested, present to the competent authority, a licence issued in accordance with the rules laid down in Article 7 and which is valid in that Member State.

Where a member of the general public intends to introduce the substances listed in Annex I, or mixtures or substances containing those substances, in concentrations higher than those laid down in that Annex, into the territory of a Member State which has derogated from paragraph 1 by applying a licensing system in accordance with paragraph 2 and/or a registration system in accordance with paragraph 2a or Article 15a, that person shall obtain, and, if requested, present a licence issued in accordance with the rules laid down in Article 5 and which is valid in that Member State to the national competent authority.

7. Within two months of being notified in accordance with paragraph 6, the Agency shall issue a recommendation in accordance with Article 18(b) on whether an approval proposed in accordance with paragraph 6 fulfils the conditions laid down in that paragraph.
