The Commission had adopted the principle of refusing to reimburse Community co-financing which exceeds the level set in the programme complement, considering that this 'front-loading' of Community part-financing exposed it to the risk that the rate set would not be respected in the long run, so proportionately reducing the multiplier effect sought.

To accept Community co-financing for a longer period would significantly reduce the availability of Community funds for co-financing of scrapping, which is clearly the priority objective in this case.

2. For the Community activities financed under this Decision, the notion of irregularity referred to in Article 1(2) of Regulation (EC, Euratom) No 2988/95 shall mean any infringement of a provision of Community law or any breach of a contractual obligation resulting from an act or omission by an economic operator which has, or would have, the effect of prejudicing the general budget of the European Communities or budgets managed by them by an unjustified item of expenditure.

In order to observe this rule, which applies without prejudice to the co-financing rule mentioned above, the percentage of Community co-financing corresponding to the grant awarded for a given financial year shall be at least 2,5 points below the percentage of Community co-financing corresponding to the grant awarded for the previous financial year.
