The European Commission presented today a package of initiatives to improve this situation. The Commission, on a proposal from Mrs Scrivener, has adopted a proposal for a Council Regulation on the elimination of controls and formalities on the cabin and checked baggage of passengers on intra-Community flights and the baggage of passengers on intra-Community sea crossings.

The Commission proposes that from 1 January 1993, without prejudice to the safety checks applicable in air and sea transport, no controls or formalities should be carried out in respect of the cabin and checked baggage of passengers taking an intra-Community flight or the baggage of passengers making an intra-Community sea crossing.

The difficulties thrown up by these arrangements are known: - if the place of taxation of the supply is shifted to the Member State in which the goods are used/consumed, taxable suppliers are burdened with obligations (identification, regular returns, etc.) which have to be complied with in Member States in which they are not established; - if taxation at destination is applied via the purchaser, statement obligations are imposed on traders normally released from them (taxable persons exempted from tax, non-taxable legal persons, individuals), who are then required to make all or part of their intra-Community acquisitions subject to the tax; - if transactions intended for consumption/use in another Member State can be exempted from VAT, the treatment of domestic and intra-Community transactions is no longer equal: intra-Community purchases require no disbursement of the amount of the tax when the purchaser is a taxable person with the full right of deduction.
Les difficultés rencontrées dans ce régime sont connues: - si le lieu d'imposition de la livraison est déplacé dans l'Etat membre d'utilisation/consommation des biens, poids des obligations à la charge des fournisseurs assujettis, ces obligations (identification, déclarations périodiques, ...) devant être accomplies dans des Etats membres où ils ne sont pas établis; - si la taxation à destination est opérée auprès de l'acheteur, obligations déclaratives à la charge d'opérateurs qui en sont en principe dispensés (assujettis bénéficiant d'un régime de franchise de taxe, personnes morales non assujetties, particuliers) et qui dès lors sont tenus de soumettre à la taxe l'ensemble ou une partie de leurs acquisitions intracommunautaires; - si les opérations destinées à une consommation/utilisation dans un autre Etat membre peuvent bénéficier d'une exonération de TVA, l'égalité de traitement entre opérations intérieures et intracommunautaires est rompue: les achats intracommunautaires n'exigent aucun décaissement du montant de la taxe lorsque l'acheteur est un assujetti ayant un droit complet à déduction.
