15. In view of what has been said so far and the largely concordant views expressed to date by the abovementioned bodies and organizations, it is apparent that the disappearance of the ECSC in 2002 raises three preliminary questions, concerning:

Whereas arrangements should therefore be introduced enabling Member States to secure the return to their territory of cultural objects which are classified as national treasures within the meaning of the said Article 36 and have been removed from their territory in breach of the abovementioned national measures or of Council Regulation (EEC) No 3911/92 of 9 December 1992 on the export of cultural goods (4); whereas the implementation of these arrangements should be as simple and efficient as possible; whereas, to facilitate cooperation with regard to return, the scope of the arrangements should be confined to items belonging to common categories of cultural object; whereas the Annex to this Directive is consequently not intended to define objects which rank as 'national treasures' within the meaning of the said Article 36, but merely categories of object which may be classified as such and may accordingly be covered by the return procedure introduced by this Directive;

WHEREAS THE BY-PRODUCTS IN QUESTION ARE VERY SIMILAR IN COMPOSITION TO THE DEHYDRATED FODDER FALLING WITHIN SUBHEADING 12.10 B OF THE COMMON CUSTOMS TARIFF ; WHEREAS , THEREFORE , PENDING A COMMUNITY DECISION ON TARIFF CLASSIFICATION , SOME MEMBER STATES HAVE CLASSIFIED THE SAID PRODUCTS WITHIN THE ABOVEMENTIONED SUBHEADING AND ESTABLISHED THE CHECKS NECESSARY FOR GRANTING AID FOR THE SAID PRODUCTS ; WHEREAS , HOWEVER , SHORTLY BEFORE 1 APRIL 1979 , WHEN THE 1979/80 MARKETING YEAR COMMENCED , THE COMMITTEE ON COMMON CUSTOMS TARIFF NOMENCLATURE DECIDED THAT THE SAID PRODUCTS SHOULD BE CLASSIFIED WITHIN SUBHEADING 23.06 ; WHEREAS PROVISION SHOULD , ACCORDINGLY , BE MADE FOR THIS REGULATION TO APPLY WITH EFFECT FROM 1 APRIL 1979 ;

Whereas, since the abovementioned aid will be restricted to the quantities sold on the Community market, provision must be made for granting production aid at a fixed rate to compensate for restricting consumption aid to the said quantities ; whereas, to avoid structural surpluses, this production aid should be granted only in respect of areas planted with olive trees on the date on which the new system enters into force;
considérant que l'aide visée ci-dessus étant limitée aux quantités vendues sur le marché communautaire, il convient de prévoir l'octroi aux producteurs d'une aide forfaitaire destinée à compenser la limitation de l'aide à là consommation aux quantités précitées ; que, afin d'éviter des excédents structurels, il y a lieu de prévoir que l'octroi de l'aide à la production soit limité aux superficies complantées en oliviers à la date d'entrée en vigueur du nouveau régime;
