Welcomes the steps taken to date by the Commission to combat UTPs with a view to securing a more balanced market and to overcoming the current fragmented situation resulting from the different national approaches to addressing UTPs in the EU, but points out that these steps are not sufficient to combat UTPs; welcomes the above-mentioned Commission report of 29 January 2016, as well as the long-expected accompanying study on the monitoring of the implementation of principles of good practice in vertical relationships in the food supply chain, but notes its conclusions, which do not pave the way for an EU-level framework to tackle unfair trading practices at EU level.

Whereas provisions enabling these disadvantages to be remedied were introduced, for the above-mentioned reasons, in Council Regulation No 121/67/EEC 2 of 13 June 1967 on the common organisation of the market in pigmeat, as last amended by Regulation (EEC) No 777/71, 3 and in Council Regulation (EEC) No 805/68 4 of 27 June 1968 on the common organisation of the market in beef and veal, as last amended by Regulation (EEC) No 1253/70 5 ; whereas for the same reasons provisions for the other sectors of animal products must be laid down;

Whereas it should be made clear that the notification referred to in the first indent of Article 32 (2) of Regulation No 1009/67/EEC places an obligation on the factory or undertaking concerned to keep the quantity carried forward in store during the period referred to in the second indent of the same subparagraph without any reimbursement of storage costs ; whereas it should also be specified that if, despite the obligation to store, that quantity is disposed of during the above-mentioned period storage costs shall not be reimbursed ; whereas, in order to prevent such disposal from making the carry forward system ineffective, it is important that the quantity concerned should continue to be treated as production within the basic quota for the following marketing year ; whereas, if that system is to be effective, the production levy applicable during the marketing year in which the sugar was produced should be charged in the event of premature disposal;
considérant qu'il y a lieu de préciser que la communication visée à l'article 32 paragraphe 2 premier tiret du règlement nº 1009/67/CEE oblige l'usine ou l'entreprise concernée à stocker la quantité reportée pendant la période visée au même paragraphe deuxièmet tiret, sans remboursement des frais de stockage ; qu'il est approprié de préciser également qu'en cas d'écoulement, malgré l'obligation de stockage, de cette quantité pendant ladite période un remboursement des frais de stockage n'est pas accordé ; que, pour éviter que cet écoulement rende inopérant le système du report, il importe que la quantité en cause continue à figurer au compte de la production situé dans le cadre du quota de base de la campagne sucrière suivante ; que, dans l'intérêt de l'efficacité de ce système, il est également indiqué de prévoir que l'écoulement prématuré entraîne la perception de la cotisation à la production applicable pendant la campagne sucrière au cours de laquelle le sucre a été produit;
