As the fifth ground for annulment, the applicant claims that the Commission made an erroneous interpretation and application of Article 107 TFEU, since without any justification it included within the financial amount to be recovered as unlawful State aid (a) part of the interest rate which in accordance with the funding arrangement and Ministerial decision No 56700/Β3033/08.12.2008 represents a contribution (contribution of 0.12% of Law 128/75) and (b) the provision in Ministerial Decision 2/21304/0025/26.10.2010 of the guarantee premium at 2 % from public funds, which do not constitute State aid and should be excluded from the final amount to be recovered.
Par le cinquième moyen d’annulation, la requérante fait valoir qu’il y a eu application et interprétation erronées de l’article 107 TFUE par la Commission qui, sans aucune justification, a inclus dans les montants à récupérer en tant qu’aides d’État illégales a) une partie de l’intérêt qui, aux termes de la convention de prêt et de l’arrêté ministériel no 56700/B3033/8 décembre 2008, constitue une cotisation (de 0,12 % au titre de la loi 128/75) et b) la commission de garantie de 2 %, prévue par l’arrêté ministériel 2/21304/0025/26 octobre 2010, en faveur de l’État, qui ne sont pas des aides d’État et qui doivent être déduites du montant final devant être récupéré.
