In order to strengthen trade mark protection and combat counterfeiting more effectively, and in line with international obligations of the Union under the framework of the World Trade Organisation (WTO), in particular Article V of the General Agreement on Tariffs and Trade (GATT) on freedom of transit and, as regards generic medicines, the ‘Declaration on the TRIPS Agreement and public health’ adopted by the Doha WTO Ministerial Conference on 14 November 2001, the proprietor of an EU trade mark should be entitled to prevent third parties from bringing goods, in the course of trade, into the Union without being released for free circulation there, where such goods come from third countries and bear without authorisation a trade mark which is identical or essentially identical with the EU trade mark registered in respect of such goods.
Afin de renforcer la protection conférée par la marque et de lutter plus efficacement contre la contrefaçon, et conformément aux obligations internationales auxquelles est soumise l'Union dans le cadre de l'Organisation mondiale du commerce (OMC), en particulier l'article V de l'accord général sur les tarifs douaniers et le commerce (GATT) relatif à la liberté de transit et, pour ce qui est des médicaments génériques, la «Déclaration sur l'accord sur les ADPIC et la santé publique» adoptée lors de la conférence ministérielle de l'OMC à Doha, le 14 novembre 2001, il convient de permettre au titulaire d'une marque de l'Union européenne d'empêcher des tiers d'introduire dans l'Union, dans la vie des affaires, des produits sans qu'ils y soient mis en libre pratique, lorsque ces produits viennent d'un pays tiers et portent sans autorisation une marque identique ou pour l'essentiel identique à la marque de l'Union européenne enregistrée pour ces produits.

Annex 1A to the Agreement establishing the World Trade Organisation (‘the WTO Agreement’) contains, inter alia, the General Agreement on Tariffs and Trade 1994 (‘the GATT 1994’), an Agreement on Agriculture (‘the Agreement on Agriculture’), an Agreement on Implementation of Article VI of the General Agreement on Tariffs and Trade 1994 and an Agreement on Subsidies and Countervailing Measures (‘the Subsidies Agreement’).

Paragraphs 3 and 4 of Article IX of the Marrakesh Agreement establishing the World Trade Organization (‘WTO Agreement’) set out the procedures for the granting of waivers concerning the Multilateral Trade Agreements in Annex 1A or 1B or 1C to the WTO Agreement and their annexes.

5 Article 2(1) of the Agreement on Trade-Related Aspects of Intellectual Property Rights (‘the TRIPs Agreement’), which constitutes Annex 1C to the Agreement establishing the World Trade Organisation, signed in Marrakesh on 15 April 1994 and approved by Council Decision 94/800/EC of 22 December 1994 concerning the conclusion on behalf of the European Community, as regards matters within its competence, of the agreements reached in the Uruguay Round multilateral negotiations (1986-1994) (OJ 1994 L 336, p. 1), provides:

The Community and Lebanon shall gradually establish a free trade area over a transitional period not exceeding 12 years from the entry into force of this Agreement according to the modalities set out in this Title and in conformity with the provisions of the General Agreement on Tariffs and Trade of 1994 and of the other multilateral agreements on trade in goods annexed to the Agreement establishing the World Trade Organisation (WTO), hereinafter referred to as the GATT.

Whereas the Agreement, together with that establishing the World Trade Organization, will enter into force on 1 January 1995 or as soon as possible after that date; whereas the developed countries which are Members of the Agreement establishing the World Trade Organization will have one year following the entry into force of that Agreement in which to implement the Agreement on trade related aspects of intellectual property rights;
considérant que cet accord, de même que celui instituant l'Organisation mondiale du commerce, entrera en vigueur le 1er janvier 1995 ou le plus tôt possible après cette date, les pays développés membres de l'accord sur l'Organisation mondiale du commerce disposant alors d'une période d'un an après l'entrée en vigueur de cet accord pour appliquer les dispositions de l'accord sur les aspects de droits de propriété intellectuelle qui touchent au commerce;

Whereas the Agreement establishing the World Trade Organization (hereinafter, the 'WTO Agreement`) was signed on behalf of the Community; whereas the Agreement on Trade-Related Aspects of Intellectual Property Rights (hereinafter, the 'TRIPs Agreement`), annexed to the WTO Agreement, contains detailed provisions on the protection of intellectual property rights whose purpose is the establishment of international disciplines in this area in order to promote international trade and prevent trade distortions and friction due to the lack of adequate and effective intellectual property protection;
considérant que l'accord instituant l'organisation mondiale du commerce (ci-après dénommé «accord sur l'OMC») a été signé au nom de la Communauté; que l'accord sur les aspects des droits de propriété intellectuelle touchant au commerce (ci-après dénommé «accord TRIPs») annexé à l'accord sur l'OMC comprend des dispositions détaillées concernant la protection des droits de propriété intellectuelle qui visent à établir des disciplines internationales dans ce domaine, de façon à promouvoir le commerce mondial et à éviter les distorsions des échanges ainsi que les différends découlant de l'absence de protection suffisante et efficace de cette propriété intellectuelle;
