Beet production in Portugal, having regard to the fact that this is a new industry, faces persistent difficulties; sugar beet producers need to be encouraged to increase production in view of these difficulties; Portugal should therefore be authorised to grant national aid for beet production over the next five marketing years in respect of the same amount and under the same conditions as for the 2000/2001 marketing year.

(20) Whereas, in particular, it is appropriate to lay down in this Directive provisions concerning the exercise by broadcasters of exclusive broadcasting rights that they may have purchased to events considered to be of major importance for society in a Member State other than that having jurisdiction over the broadcasters, and whereas, in order to avoid speculative rights purchases with a view to circumvention of national measures, it is necessary to apply these provisions to contracts entered into after the publication of this Directive and concerning events which take place after the date of implementation, and whereas, when contracts that predate the publication of this Directive are renewed, they are considered to be new contracts;
(20) considérant notamment qu'il convient, dans la présente directive, de prévoir des dispositions concernant l'exercice, par les organismes de radiodiffusion télévisuelle, de droits exclusifs de retransmission qu'ils auraient achetés pour des événements jugés d'une importance majeure pour la société dans un État membre autre que celui qui est compétent pour les organismes de radiodiffusion télévisuelle; que, afin d'éviter les achats spéculatifs de droits visant à tourner les mesures nationales, il convient d'appliquer les dispositions en question aux contrats conclus après la publication de la présente directive et pour les événements qui ont lieu après la date de mise en oeuvre de la présente directive; que, en cas de renouvellement de contrats antérieurs à la publication de la présente directive, lesdits contrats sont considérés comme de nouveaux contrats;

2. The distribution and renting of films shall be regarded as comprising any activity involving the making over of the rights of commercial exploitation of a film with a view to its being distributed on a commercial basis in a specific market and the temporary transfer of the right of public exhibition to any person who directly organises the exhibition of films in the host country.

Sont considérées comme activités de distribution et de location des films, toutes les activités comportant disposition des droits d'exploitation économique d'un film en vue de sa diffusion commerciale dans un marché déterminé et la cession, à titre temporaire, des droits de représentation publique à tous ceux qui organisent directement de telles représentations dans le pays d'accueil.
