These simplifications relate to three types of transaction: - intra-Community purchases of products subject to excise duty (fuels, tobacco, spirits), the aim here being to ease the burden imposed by the need to monitor VAT; - trade with certain territories which belong to the "customs territory" of the Community but not to its "tax territory"; - "triangular transactions" i.e. those where a firm in country A purchases goods in country B with a view to supplying them to a customer in country C. This last simplification is particularly important for companies because it will obviate the need for the seller to register for VAT purposes in country C or to employ a tax representative there. The customer will be directly designated as the party liable to pay the VAT.
Trois séries d'opérations sont concernées par ces simplifications : - les achats intracommunautaires de produits soumis à accises (carburants, tabacs, alcools) de façon à alléger les obligations de contrôle TVA; - les échanges avec certains territoires qui appartiennent au "territoire douanier" de la Communauté sans faire partie de son "territoire fiscal". - les opérations triangulaires c'est-à-dire les opérations par lesquelles une entreprise d'un pays A a acheté des biens dans un pays B pour les livrer à un client étallé dans un pays C. Cette dernière simplification est particulièrement importante pour les entreprises car elle évitera au vendeur de s'immatriculer à la TVA dans le pays C ou de recourir à un représentant fiscal dans le pays C. The simplification measure envisaged will treat goods from those territories in the same way as goods from third countries, with it then being possible to apply VAT to them when they enter a Member State. 3. Triangular transactions These are transactions where a firm A in country A purchases goods from firm B in country B with a view to supplying them to customer C in country C. Under the current transitional VAT arrangements, such a transaction has to be broken down into two successive transactions: - first, an intra-Community supply effected by firm B to firm A in country C. If firm A does not have a branch in the country of destination (country C), it will be required, for that particular transaction, to register for VAT in that country; - second, a domestic sale effected by firm A to firm C in country C. Under the simplification measure proposed, the intermediate stage at which tax considerations obliged firm A to intervene in country C is dispensed with. Firm A will thus be able to designate firm C directly as the person liable to pay VAT.

Si l'entreprise A n'a pas de succursale dans le pays de destination (pays C), cela l'oblige, pour la circonstance, à s'immatriculer à la TVA dans ce pays; - ensuite, une vente intérieure de l'entreprise A à l'entreprise C dans le pays C. La simplification prévue vise à sauter l'étape intermédiaire qui consistait à faire intervenir, pour les besoins des obligations fiscales l'entreprise A dans le pays C. L'entreprise A pourra ainsi désigner directement l'entreprise C comme redevable de la TVA.
