It concluded that the existing Directive is insufficient given the growing import dependence and increased supply and transit risks in third countries as well as, increasing gas flows and the development of the internal gas market within the Community.

This Directive is no longer sufficient in a context of growing import dependence and increased supply and transit risks in third countries as well as increasing gas flows and the development of the internal gas market within the Community.

To help ensure such a market and in order to ensure further greenhouse gas emission reductions within the Community, and thus enhance the implementation of the objectives of the Community relating to renewable energy, energy efficiency, energy security, innovation and competitiveness, it is proposed to allow the annual use by Member States of credits from greenhouse gas emission reduction projects in third countries, up to a quantity representing 3 % of the greenhouse gas emissions of each Member State not covered under Directive 2003/87/EC in 2005, or in other Member States, until an international agreement on climate change has been reached.
À cette fin, et pour garantir de nouvelles réductions des émissions de gaz à effet de serre dans l’Union et encourager ainsi la réalisation des objectifs de la Communauté en matière d’énergies renouvelables, d’efficacité énergétique, de sécurité énergétique, d’innovation et de compétitivité, il est proposé d’autoriser les États membres à utiliser, chaque année, des crédits provenant de projets de réduction des émissions de gaz à effet de serre menés dans les pays tiers, à concurrence d’une quantité représentant 3 % des émissions de gaz à effet de serre de chaque État membre non couvertes par la directive 2003/87/CE pour 2005, ou dans d’autres États membres, dans l’attente de la conclusion d’un accord international sur le changement climatique.

‘Where emissions of a greenhouse gas from an installation are specified in Annex I to Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC in relation to an activity carried out in that installation, the permit shall not include an emission limit value for direct emissions of that gas unless it is necessary to ensure that no significant local pollution is caused.
«Lorsque les émissions d'un gaz à effet de serre provenant d'une installation sont spécifiées à l'annexe I de la directive 2003/87/CE du Parlement européen et du Conseil du 13 octobre 2003 établissant un système d'échange de quotas d'émission de gaz à effet de serre dans la Communauté et modifiant la directive 96/61/CE du Conseil en relation avec une activité exercée dans cette installation, l'autorisation ne comporte pas de valeur limite d'émission pour les émissions directes de ce gaz, à moins que cela ne soit nécessaire pour éviter toute pollution locale significative.

(10) Whereas the competent authorities should ensure that products leaving the Community or in transit to a particular destination are in fact those which have undergone the customs export formalities; whereas, to this end, when a product crosses the territory of other Member States before leaving the customs territory of the Community or reaching a particular destination, use should be made of the T5 control copy referred to in Articles 471 to 495 of Commission Regulation (EEC) No 2454/93 of 2 July 1993 laying down provisions for the implementation of Council Regulation (EEC) No 2913/92 establishing the Community Customs Code(8), as last amended by Regulation (EC) No 502/1999(9); whereas, however, it seems desirable, in order to simplify administrative procedure, to provide more flexible arrangements than the use of the T5 control copy, in the case of transactions under the simplified Community transit procedures for carriage by rail or large containers under Articles 412 to 442 of Regulation (EEC) No 2454/93, which provides that when a transport operation begins within the Community and is to end outside it, no formalities need to be carried out at the customs office of the frontier station;
(10) considérant que les autorités compétentes doivent s'assurer que les produits qui sortent de la Communauté ou qui sont livrés en vue de certaines destinations sont bien les mêmes que ceux qui ont fait l'objet des formalités douanières d'exportation; que, à cet effet, lorsqu'un produit, avant de quitter le territoire douanier de la Communauté ou d'atteindre une destination particulière, traverse le territoire d'autres États membres, il convient d'utiliser l'exemplaire de contrôle T 5 visé aux articles 471 à 495 du règlement (CEE) no 2454/93 de la Commission du 2 juillet 1993 fixant certaines dispositions d'application du règlement (CEE) no 2913/92 du Conseil établissant le code des douanes communautaire(8), modifié en dernier lieu par le règlement (CE) no 502/1999(9); que, toutefois, il paraît souhaitable, pour des raisons de simplification administrative, de prévoir une procédure plus souple que celle de l'exemplaire de contrôle T 5 lorsqu'il est fait application du régime de transit communautaire simplifié par fer ou par grands conteneurs prévu aux articles 412 à 442 du règlement (CEE) no 2454/93, qui dispose que, lorsqu'un transport débute à l'intérieur de la Communauté et doit se terminer à l'extérieur de celle-ci, aucune formalité n'est à accomplir au bureau de douane auquel ressortit la gare frontière;
