If it is concluded, on the basis of a risk assessment, that the plant, plant product or other object originating in the third country, group of third countries or specific area of the third country concerned referred to in paragraph 2, on the taxonomic level as listed in the implementing act provided for in paragraph 3 or below that level, does not pose a risk of an unacceptable level by its likelihood to host a Union quarantine pest, the Commission shall adopt an implementing act removing that plant, plant product or other object from the list referred to in that paragraph for the third countries concerned.

In order to ensure that the exceptions for Union quarantine pests and for plants, plant products and other objects originating from third countries or territories which are prohibited from being introduced into the Union territory, used for official testing, scientific or educational purposes, trials, varietal selection or breeding are implemented in a manner that does not pose any pest risk to the Union territory or parts of it, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of rules concerning the exchange of information between Member States and the Commission as regards the introduction into, movement within, and holding, multiplication and use in, the Union territory of the pests and plants, plant products and other objects concerned, the procedure and conditions for granting the corresponding authorisation, and the monitoring of compliance as well as the actions to be taken in the event of non-compliance.

Believes that the Treaty of Lisbon and the recognition of the legally binding force of the Charter of Fundamental Rights of the European Union have brought significant improvements and strengthened the constitutional basis for the EU institutions and the Member States to achieve the objective of establishing an area of freedom, security and justice, but observes that some areas require additional efforts, in particular as regards their implementation; considers that this objective requires the Treaties and secondary law to be applied evenly throughout the EU; agrees, therefore, that opt-outs or special regimes should be avoided, and where possible removed; requests that the Commission and the Council Presidency better fulfil their obligation to inform Parliament ‘immediately and fully at all stages of the procedure’ leading to the conclusion of international agreements; regrets the delays in bringing the acts of the former third pillar into line with the new hierarchy of norms – basic, delegated and implementing acts – in accordance with the Treaty of Lisbon and the new institutional structure;

Urges the institutions to work closely together as regards delegated and implementing acts; understands that delegated acts can be a flexible and effective tool, but stresses the need to respect fully Parliament’s prerogatives and responsibilities, including through compliance with the basic act and the provision of timely and complete information to Parliament to allow for proper scrutiny of delegated acts; in this context, points out that the adoption of delegated acts without proper information, or under time constraints, could undermine Parliament’s scrutiny; on the other hand, welcomes Parliament’s attendance at expert meetings as provided for in the FA, with the aim of ensuring that all draft acts adopted by the Commission take an appropriate form so as to avoid possible technical objections from the legislator regarding their legal qualification; insists that the use of implementing acts be limited to cases where they are legally justified and are not being used as an alternative to delegated acts; expresses its hope that in the future the delays for adopting legislation in the field of trade will not be as long as in the case of the new delegated/implementing acts regime;

A delegated act adopted pursuant to Article 2(3), point ((c) of Article 4(4), point ((b) of Article 4(5), Article 16(2), Article 29(6), Article 34b(11) or Article 45(1) shall enter into force only if no objection has been expressed either by the European Parliament or the Council within a period of two months of notification of that act to the European Parliament and the Council or if, before the expiry of that period, the European Parliament and the Council have both informed the Commission that they will not object.
5. If, on the expiry of the period referred to in paragraph 1, neither the European Parliament nor the Council has objected to the delegated act, or if both the European Parliament and the Council have informed the Commission that they do not intend to object, the act shall be published in the Official Journal of the European Union and shall enter into force on the date stated therein.
