If a Party conditions the granting of a licence to supply public telecommunications services to a person of the Party in which a person of the other Party holds an equity interest on a finding that the supply of such services would serve the public interest, the Party shall ensure that it: (i) bases any such finding and the procedures for making such a finding on objective and transparent criteria; (ii) employs a presumption in favor of finding that granting a licence to a person of the Party in which a person of the other Party holds an equity interest would serve the public interest; and (iii) develops any such procedures consistent with Article 7.22 (Transparency and Confidential Information), Article 7.23 (Domestic Regulation) and Article 7.36 (Resolution of Telecommunications Disputes).

MUTUAL RECOGNITION OF LICENCES AND OTHER NATIONAL AUTHORIZATIONS FOR TELECOMMUNICATIONS AND SATELLITE NETWORK AND/OR SATELLITE COMMUNICATIONS SERVICES The Council took note of progress on two proposals for Directives on: - mutual recognition of licences and other national authorizations for telecommunications services - a policy for the mutual recognition of licences and other national authorizations for the provision of satellite network services and/or satellite communications services.
RECONNAISSANCE MUTUELLE DES LICENCES ET AUTRES AUTORISATIONS NATIONALES POUR LA PRESTATION DE SERVICES DE TELECOMMUNICATIONS ET DE RESEAUX SATELLITES ET/OU SERVICES DE COMMUNICATIONS PAR SATELLITE Le Conseil a pris acte de l'état des travaux concernant deux propositions de directive concernant respectivement - la reconnaissance mutuelle des licences et autres autorisations nationales pour la prestation de services de télécommunications - une politique sur la reconnaissance mutuelle des licences et autres autorisations nationales pour la prestation de services de réseaux satellites et/ou de services de communications par satellite.

It would also aim to harmonise phone numbers on an EC-wide basis, as well as establishing access to telephone inquiries services covering the whole Community. 2. Licences The Commission is proposing a directive - which is also part of the harmonization strategy - aiming to establish a balanced and efficient procedure for the mutual recognition of licences, across the Community including a single Community licence, and other authorisations for the provision of telecommunications services issued by the member states. A Community Telecommunications Committee would assist the Commission in carrying out this work.

OTHER BUSINESS The Council noted Mr BANGEMANN's presentation of the following proposals: (a) new proposal for a Directive of the European Parliament and of the Council on licences for telecommunications services This proposal, which the Commission adopted on 14 November 1995, replaces the two proposals that the Commission submitted in 1992 and 1993 on the mutual recognition of licences and other authorizations for telecommunications services and satellite communications services that the Council examined under the German Presidency in 1994.
