Interpreting the same provision in the Act of Accession Treaty for the Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and the Slovak Republic, the Court of Justice in a recent case C-161/06, Skoma-Lux sro v Celní ředitelství Olomouc, held that the obligations contained in Community legislation which has not been published in the Official Journal of the European Union in the language of a new Member State, where that language is an official language of the European Union, could not be imposed on individuals in that State.
Interprétant la même disposition dans le traité de l’Acte d’adhésion pour la République Tchèque, l’Estonie, Chypre, la Lettonie, la Lituanie, la Hongrie, Malte, la Pologne, la Slovénie et la République slovaque, la Cour de Justice, dans un cas récent C-161/06, Skoma-Lux sro v Celní ředitelství Olomouc, a estimé que les obligations formulées dans la législation Communautaire qui n’ont pas été publiées au Journal Officiel de l’Union européenne dans la langue d’un nouvel État membre, où cette langue est une langue officielle de l’Union européenne, ne peuvent pas être imposées aux ressortissants de cet État membre.
