3.4.1 Traditional music and oral history is very important to the cultural heritage of Europe and there is a rich archive of recorded material throughout the EU, not only in public service broadcast organisations but also in the other institutions listed in Article 1(1).

1.10 The Committee draws the attention of the Commission to the importance of traditional music, oral history, photographs and cinematographic works to the cultural heritage of the EU and requests that such recordings and images in the archives of any institution listed in Article 1(1) will receive equal treatment in the identification and publication of orphan works.

Member States shall ensure that when interviews with a suspected or accused person have been conducted by an investigative or judicial authority with the aid of an interpreter pursuant to Article 2, when an oral translation or oral summary of essential documents is provided in the presence of such an authority pursuant to Article 3(6), or when there is a waiver of rights pursuant to Article 3(7), it will be noted that these events have occurred, using the recording procedure in accordance with the national law of the Member State concerned.

This may include for example objects, documents or data from a third party, from a search of premises including the private premises of the suspect, historical data on the use of any services including financial transactions, historical records of statements, interviews and hearings, and other records, including the results of special investigative techniques.
