In relation to the carriage performed by the actual carrier, any servant or agent of that carrier or of the contracting carrier shall, if they prove that they acted within the scope of their employment, be entitled to avail themselves of the conditions and limits of liability which are applicable under this Convention to the carrier whose servant or agent they are, unless it is proved that they acted in a manner that prevents the limits of liability from being invoked in accordance with this Convention.

In relation to the carriage performed by the actual carrier, any servant or agent of that carrier or of the contracting carrier shall, if he proves that he acted within the scope of his employment, be entitled to avail himself of the limits of liability which are applicable under this Convention to the carrier whose servant or agent he is unless it is proved that he acted in a manner which, under the Warsaw Convention, prevents the limits of liability from being invoked.

Any contractual provision tending to relieve the contracting carrier or the actual carrier of liability under this Chapter or to fix a lower limit than that which is applicable according to this Chapter shall be null and void, but the nullity of any such provision does not involve the nullity of the whole contract, which shall remain subject to the provisions of this Chapter.
Toute clause tendant à exonérer le transporteur contractuel ou le transporteur de fait de leur responsabilité en vertu du présent chapitre ou à établir une limite inférieure à celle qui est fixée dans le présent chapitre est nulle et de nul effet, mais la nullité de cette clause n'entraîne pas la nullité du contrat qui reste soumis aux dispositions du présent chapitre.

1. Any contractual provision tending to relieve the contracting carrier or the actual carrier of liability under this Convention or to fix a lower limit than that which is applicable according to this Convention shall be null and void, but the nullity of any such provision does not involve the nullity of the whole agreement, which shall remain subject to the provisions of this Convention.

The operating air carrier shall not apply the limitations set out in Articles 9(4) and 9 (5) if the passenger is a person with reduced mobility or any person accompanying him/her, an unaccompanied child, a pregnant woman or a person in need of specific medical assistance, on condition the air carrier or its agent or the organiser has been notified of their particular needs for assistance at least 48 hours before the scheduled time of departure of the flight. Such notification shall be deemed to cover the entire journey and the return journey if both journeys have been contracted with the same air carrier .‘
Le transporteur aérien effectif n'applique pas les limitations fixées par l'article 9, paragraphes 4 et 5, si le passager est une personne à mobilité réduite ou toute personne qui l'accompagne, un enfant non accompagné, une femme enceinte ou une personne nécessitant une assistance médicale spécifique, à condition que le transporteur aérien, son agent ou l'organisateur ait été informé de leurs besoins particuliers d'assistance au moins 48 heures avant l'heure de départ prévue du vol. 3. Any contractual provision concluded before the occurrence of the incident which has caused the death of or personal injury to a passenger or the loss of or damage to the passenger's luggage, purporting to relieve any person liable under this Convention of liability towards the passenger or to prescribe a lower limit of liability than that fixed in this Convention except as provided in Article 8, paragraph 4, and any such provision purporting to shift the burden of proof which rests on the carrier or performing carrier, or having the effect of restricting the options specified in Article 17, paragraphs 1 or 2, shall be null and void, but the nullity of that provision shall not render void the contract of carriage which shall remain subject to the provisions of this Convention.

Air carriers shall ensure that any other co-mail or co-mat shipment made on behalf of the carrier by a contract organisation such as, but not limited to, catering equipment and stores, cleaning supplies and other materials handled by contracted service providers, is inspected prior to loading on board aircraft.
Le transporteur aérien veille à ce que tout envoi de courrier "co-mail" ou de matériel "co-mat" effectué au nom du transporteur par une organisation agréée, comme, sans que cette liste soit limitative, des provisions et des fournitures pour la restauration, des produits de nettoyage et autre matériel traité par des sous-traitants, fassent l'objet d'une inspection avant chargement à bord de l'aéronef.

A claimant can take legal action against either carrier, but the total amount of damages is limited to the amounts set under the Warsaw Convention, unless the passenger and the contract carrier have agreed on a higher amount.
Un demandeur peut intenter une action en justice contre l'un ou l'autre des transporteurs, mais l'ensemble des dommages est limité aux montants prescrits par le régime de Varsovie, sauf si le passager et le transporteur à contrat ont convenu d'un montant supérieur, auquel cas l'entente ainsi conclue n'a pas pour effet de lier le transporteur exploitant qui n'a pas accepté ce nouveau montant.
