[1] The present report is prepared in accordance with art. 10 of Council Regulation (EEC) No 3906/89 of 18 December 1989 ("Phare Regulation"), art. 11 of Council Regulation (EC) No 555/2000 of 13 March 2000 on the implementation of operations in the framework of the pre-accession strategy for the Republic of Cyprus and the Republic of Malta and art. 11 of Council Regulation (EC) No 2500/2001 of 17 December 2001 concerning pre-accession financial assistance for Turkey.

[3] The Pact is anchored in the Treaty on the Functioning of the EU (TFEU) and consists of Council Regulation (EC) No 1466/97 (the "preventive arm", based on Art. 121 TFEU) and Council Regulation (EC) No 1467/97 (the "corrective arm", based on Art. 126 TFEU), as well as their subsequent amendments and related legislation.

Following this and on request from France the European Council, based on Art. 355 (2 and 6), changed by way of Decision 2012/419/EU the status of this new overseas department with regard to the European Union into that of an outermost region in the sense of Art. 349 TFEU.
À la suite à ce changement et sur demande de la France, le Conseil européen a, sur la base de l'article 355, paragraphes 2 et 6, modifié par la décision 2012/419/UE le statut du nouveau département d'outre-mer à l'égard de l'Union européenne, qui est devenu celui d'une région ultrapériphérique au sens de l'article 349 du traité sur le fonctionnement de l'Union européenne.

If a beneficiary country listed in Annex I of this Regulation is, pursuant to a decision of the Council acting under Art. 49, paragraph 1, first sentence of the Treaty on European Union, granted Candidate status, the Council, acting by qualified majority on the basis of a proposal from the Commission will transfer that country from Annex I to Annex II.
Si, conformément à une décision du Conseil agissant en vertu de l'article 49, paragraphe 1, première phrase, du traité sur l'Union européenne, le statut de candidat est accordé à un pays bénéficiaire figurant à l'annexe 1 du présent règlement, le Conseil, agissant à la majorité qualifiée sur proposition de la Commission, transfère ce pays de l'annexe 1 à l'annexe 2.

It also proposed, that, instead of proposing detailed amendments to certain parts that have been amended by the Council, in particular Art 21.2., to introduce a grandfathering clause along the lines of the original Directive of 1985.

(12) The Sixth Council Directive (77/388/EEC) of 17 May 1977 on the harmonisation of the laws of the Member States relating to turnover taxes - common system of value added tax: uniform basis of assessment(5), progressively introduces a Community system of taxation applicable inter alia to works of art. Measures confined to the tax field are not sufficient to guarantee the harmonious functioning of the art market.
(12) La sixième directive 77/388/CEE du Conseil du 17 mai 1977 en matière d'harmonisation des législations des États membres relatives aux taxes sur le chiffre d'affaires - système commun de taxe sur la valeur ajoutée: assiette uniforme(5), instaure progressivement un régime communautaire de taxation applicable, entre autres, dans le domaine des objets d'art.
