whereas Prime Minister Hun Sen has been in power for over 30 years; whereas Sam Rainsy, the president of the leading opposition party, the CNRP, remains in self-imposed exile driven by previous prosecutions on trumped-up politically motivated charges, and whereas acting CNRP president, Kem Sokha, is under investigation; whereas on 22 April 2016 a Phnom Penh court prosecutor announced that CNRP president Sam Rainsy would face trail in absentia on further politically motivated charges, starting on 28 July 2016.

whereas on 26 April 2016 the Phnom Penh court indicted Rong Chhun, a former trade union leader who is currently a member of the NEC, for trial on trumped-up politically motivated charges of incitement to violence provoked by the government security force’s suppression of strikes by workers in late December 2013 and early January 2014; whereas two important elections are due to be held (communal elections in 2017 and parliamentary elections in 2018), and whereas applying pressure on the NEC is a method used by the government to influence these elections.
considérant que le 26 avril 2016, le tribunal de Phnom Penh a inculpé Rong Chhun, ancien dirigeant syndical actuellement membre de la commission électorale nationale, du faux motif politique d'incitation à la violence provoquée par la répression, par les forces de sécurité gouvernementales, des grèves menées par les travailleurs fin décembre 2013 et début janvier 2014; que deux grandes échéances électorales approchent (les élections municipales en 2017 et les élections législatives en 2018) et que, pour influencer l'issue de ces élections, le gouvernement fait notamment pression sur la commission électorale nationale.

E. whereas Cambodia National Rescue Party (CNRP) leaders Sam Rainsy and Kem Sokha were summoned to appear at the Phnom Penh Municipal Court on 14 January 2014 for questioning; whereas Sam Rainsy and Kem Sokha may be convicted of incitement to civil unrest;
E. considérant que les dirigeants du parti du sauvetage national du Cambodge (CNRP), MM. Sam Rainsy et Kem Sokha, ont été convoqués et interrogés par le tribunal municipal de Phnom Penh le 14 janvier 2014; considérant qu'ils risquent d'être inculpés pour incitation au trouble de l'ordre public;

– having regard to the joint statement issued at the eighth meeting of ASEAN Ministers for Social Welfare and Development of 6 September 2013 in Phnom Penh in preparation for the ASEAN summit scheduled for October 2013 and the provision contained therein that access to social protection is a basic human right,
