(30) Member States should provide for effective, proportionate and dissuasive sanctions for breaches of the requirements for an open and transparent procedure set out in this Directive, which could include, inter alia, administrative fines, exclusion from public calls for tenders, partial exclusion from the award of funding from the Union's Structural Funds, and nullity or annulment declared by a judicial body of the appointment or of the election of non-executive directors made contrary to the national provisions adopted pursuant to Article 4(1).
(30) Les États membres devraient mettre en place des sanctions effectives, proportionnées et dissuasives réprimant les violations des exigences en matière d'ouverture et de transparence des procédures énoncées dans la présente directive, sanctions qui pourraient consister, notamment, en amendes administratives, en l'exclusion des appels d'offres publics, en l'exclusion partielle des financements des Fonds structurels de l'Union, et en la nullité ou l'annulation, respectivement constatée ou prononcée par un organe judiciaire, de la nomination ou de l'élection d'administrateurs non exécutifs qui a eu lieu en violation des dispositions nationales adoptées en vertu de l'article 4, paragraphe 1.

2. Without prejudice to paragraph 1, this Regulation shall not affect the continuation or modification, including the total or partial termination, of the actions concerned, until their closure, or until the award of financial assistance by the Commission or funding bodies under Decision No 1982/2006/EC or any other legislation applying to that assistance on 31 December 2013, which shall continue to apply to the actions concerned until their closure.
2. Sans préjudice du paragraphe 1, le présent règlement n'affecte pas la poursuite ou la modification, y compris la suppression totale ou partielle, des actions concernées jusqu'à leur achèvement, ou jusqu'à l'octroi d'une aide financière par la Commission ou par des organismes de financement au titre de la décision n° 1982/2006/CE ou de tout autre acte législatif régissant ladite aide au 31 décembre 2013, qui continuent de s'appliquer aux actions concernées jusqu'à leur achèvement.
