Following entry into force of the TEU on 1 November and in view of the fact that the Committee of Governors of the central banks, the Monetary Committee and the European Parliament (1) had given their opinions, the Council proceeded to adopt: (1) The text concerning privileges and immunities, on which the European Parliament has not yet delivered its Opinion, will be adopted later. - the following four acts: = Regulation on the application of the Protocol on the excessive deficit procedure annexed to the Treaty = Decision on the statistical data to be used for the determination of the key for the financial resources of the European Monetary Institute = Decision on the consultation of the European Monetary Institute by the authorities of the Member States on draft legislative provisions = Regulation modifying Regulation No 260/68 which lays down the conditions and procedure for applying the tax for the benefit of the European Communities. - two common positions: = on a Regulation specifying definitions for the application of the prohibition of privileged access referred to in Article 104a of the Treaty = on a Regulation specifying definitions for the application of the prohibitions referred to in Articles 104 and 104b(1) of the Treaty, to which the co-operation procedure applies.
Suite à l'entrée en vigueur du TUE le 1er novembre, et compte tenu du fait que les différents avis du Comité des Gouverneurs des BC, du Comité monétaire et du Parlement européen(1) ont été donnés, le Conseil a procédé à l'adoption - des 4 actes suivants : = Règlement relatif à l'application du protocole sur la procédure concernant les déficits excessifs annexé au Traité = Décision relative aux données statistiques à utiliser pour la détermination de la clé de répartition des ressources financières de l'Institut monétaire européen = Décision relative à la consultation de l'Institut monétaire européen par les autorités des Etats membres au sujet de projets de réglementation = Règlement modifiant le règlement n° 260/68, portant fixation des conditions et de la procédure d'application de l'impôt établi au profit des Communautés européennes - de deux positions communes = règlement précisant les définitions en vue de l'application de l'interdiction de l'accès privilégié énoncée à l'article 104 A du Traité = règlement précisant les définitions nécessaires à l'application des interdictions énoncées à l'article 104 et à l'article 104 B paragraphe 1 du Traité pour lesquelles la procédure de coopération s'applique.

The compromise involved the following: - the percentage of optional set-aside to be deducted for the purpose of calculating the possible application of special set-aside is fixed at 85%; - the Commission will authorize the Member States to use the provision concerning special set-aside as from 1996 provided that the Member State concerned provides it with detailed information on the areas voluntarily set aside for the 1995 harvest; - the Commission will be authorized to grant derogations in connection with the special set-aside where the base areas are exceeded because of exceptional weather which has caused average yields to fall to a level far below normal; - in view of the exceptional market situation, the special set-aside of less than 1% will not be applied in 1996; - as regards the possibility open to the Member States of applying single national base areas with, however, the option of concentrating any penalties for exceeding those areas wholly or partially on the regions/base areas responsible for exceeding them, the Council took note of the Commission's intention of making an appropriate proposal within two months and it undertook to decide within a month of receiving the European Parliament's Opinion; - the Council also noted the Commission's intention of submitting to it, at the earliest opportunity, a proposal concerning durum wheat-production rights.
Le compromis comporte les éléments suivants : - le pourcentage de gel volontaire à déduire aux fins du calcul d'une application éventuelle du gel extraordinaire est fixé à 85%; - la Commission autorisera les Etats membres à utiliser la disposition concernant le gel extraordinaire dès 1996 à condition que l'Etat membre concerné lui fournisse des informations détaillées sur les superficies gelées volontairement en vue de la récolte de 1995; - la Commission est autorisée à octroyer des dérogations en ce qui concerne le gel extraordinaire lorsque les superficies de base ont été dépassées en raison de conditions climatiques exceptionnelles qui ont eu pour effet de faire tomber les rendements moyens à un niveau très inférieur à la normale; - compte tenu de la situation exceptionnelle du marché, le gel extraordinaire de moins de 1% ne sera pas appliqué en 1996; - en ce qui concerne la possibilité pour les Etats membres d'appliquer une superficie de base nationale unique avec cependant l'option de concentrer d'éventuelles pénalités pour dépassement de cette superficie, en totalité ou en partie, sur les régions/superficies de base qui en sont responsables, le Conseil a pris note de l'intention de la Commission de faire une proposition appropriée dans un délai de deux mois, et il s'est engagé à prendre une décision dans le délai d'un mois après avoir reçu l'avis du Parlement européen; - le Conseil a également pris note de l'intention de la Commission de lui soumettre, dans les meilleurs délais, une proposition relative aux transferts des droits à la production de blé dur.
