Do Article 41(1) of the Additional Protocol of 23 November 1970 to the Agreement of 12 September 1963 establishing an Association between the European Economic Community and Turkey for the transitional stage of the Association (AP) and/or Article 13 of Decision No 1/80 of the EEC-Turkey Association Council of 19 September 1980 (Decision No 1/80) preclude a provision of national law which was introduced for the first time after the abovementioned provisions had come into force and which makes the first entry of a member of the family of a Turkish national who enjoys the legal status under Article 6 of Decision No 1/80 conditional on the requirement that, prior to entry, the family member can demonstrate the ability to make himself or herself understood, in a basic way, in the German language?
L’article 41, paragraphe 1, du protocole additionnel du 23 novembre 1970 relatif aux mesures à prendre au cours de la phase transitoire de l’association créée par l’accord du 12 septembre 1963 entre la Communauté économique européenne et la Turquie (ci-après le «protocole additionnel») et/ou l’article 13 de la décision no 1/80 du conseil d’association, du 19 septembre 1980, relative au développement de l’association (ci-après la «décision no 1/80») s’opposent-ils à une disposition de droit national qui, postérieurement à leur entrée en vigueur, prévoit que, pour pouvoir entrer pour la première fois sur le territoire de la République fédérale d’Allemagne, le membre de la famille d’un ressortissant turc bénéficiant du statut conféré par l’article 6 de la décision no 1/80 doit prouver au préalable qu’il peut s’exprimer en allemand avec des mots simples?

3. Member States shall ensure that the responsibility for the safe operation of the railway system and the control of risks associated with it is laid upon the infrastructure managers and railway undertakings, obliging them to implement necessary risk control measures, where appropriate in cooperation with each other, to apply national safety rules and standards, and to establish safety management systems in accordance with this Directive.

Les États membres veillent à ce que la responsabilité d’une exploitation sûre du système ferroviaire et de la maîtrise des risques qui en résultent soit assumée par les gestionnaires de l’infrastructure et les entreprises ferroviaires, en les obligeant à mettre en œuvre les mesures nécessaires de maîtrise des risques, le cas échéant en coopération les uns avec les autres, à appliquer les règles et normes de sécurité nationales, et à établir des systèmes de gestion de la sécurité conformément à la présente directive.

The implementation of these actions will rely on the specific information and assistance structures, including the network of national contact points, established by the Member States and the associated countries at local, regional and national level and will aim at ensuring a smooth transition from the fifth to the sixth framework programme.
La mise en oeuvre de ces actions reposera sur des structures spécifiques d'information et d'assistance, y compris le réseau des points de contact nationaux, mises en place par les États membres et les pays associés à l'échelon local, régional et national afin d'assurer une transition sans heurts entre le cinquième et le sixième programme-cadre.
