(4) The national safety mark must be at least 50 mm in diameter and be stitched onto the restraint system or booster seat, indelibly moulded into or onto it, or indelibly printed on a label affixed to it in a permanent manner.

External appearance: The cheese is wheel-shaped with a diameter of 180-200 mm and a height of approximately 10 cm (weight approximately 2,8 kg); marks of treatment by washing or scraping on the rind, bluish-green mould growing throughout the cheese and a partly waxy finish on the surface of the cheese are not signs of flaws.

3. Any mould or matrix which is specifically designed or adapted for the manufacture of a counterfeit trade mark or of goods bearing such a trade mark, for the manufacture of goods infringing a patent or a certificate or for the manufacture of pirated goods shall be treated as goods referred to in paragraph 2(a), provided that the use of such moulds or matrices infringes the rights of the holder of the right in question under Community law or the law of the Member State in which the application for action by the customs authorities is made.

2.3. The markings referred to in 2.1 and the component type approval mark prescribed in Section 3 of Annex I shall be moulded into or onto the tyres.

Any mould or matrix which is specifically designed or adapted for the manufacture of a counterfeit trade mark or of goods bearing such a trade mark or of pirated goods shall be treated as 'counterfeit or pirated goods', as appropriate, provided that the use of such moulds or matrices infringes the rights of the holder of a right under Community law or the law of the Member State in which the application for action by the customs authorities is made.

At the time of the vote, Parliament singled out the three substantial innovations contained in the Commission's proposed new mechanism (information memo P-31 of 13 July 1993): - The widening of protection to include intellectual property rights and related rights (moulds, designs, tools, etc.). Only marks had hitherto received protection.
Le Parlement européen, lors de son vote, a mis en exergue les trois innovations majeures du nouveau dispositif avancé par la Commission dans sa proposition (note P - 31, du 13 juillet 1993) : - L'élargissement du dispositif de protection aux droits de propriété intellectuelle et droits voisins (formes, dessins, outils, etc.), alors que jusqu'à présent seules les marques étaient protégées.

The new proposal is accordingly designed to remedy these. 1. It extends the scope of the legislation so that it covers not only counterfeit goods, as at present, but also pirated goods, (i.e. goods made without the consent of the holder of the copyright or related rights, including designs rights. 2. It broadens the definition of the term "counterfeit goods" to take in not only the goods themselves, as is already the case, but the actual trade mark symbol (logo), packaging bearing the marks of the products, and tools, moulds or similar materials specifically intended for the manufacture of counterfeit marks or products. 3. It allows the customs authority itself to decide on applications by trade mark owners (in some Member States applications currently have to go through the judicial authorities, a time-consuming and cumbersome procedure).
La présente proposition vise à y remédier en : - élargissant le champ d'application du règlement de façon à couvrir, non seulement les marchandises de contrefaçon (situation actuelle) mais aussi les marchandises pirates, à savoir celles faites sans le consentement du titulaire du droit d'auteur ou des droits voisins, ainsi que des dessins et modèles; - élargissant la définition même des marchandises de contrefaçon, en y incluant non seulement les marchandises portant indûment une marque (ce qui est le cas aujourd'hui) mais aussi les signes de marques eux- même (logos), les emballages revêtus des marques des produits auxquels ils se réfèrent, les outils, moules, matériels spécifiquement destinés à la fabrication d'une marchandise contrefaite; - reconnaissant l'autorité douanière comme autorité compétente pour statuer sur la demande présentée par le titulaire de marque.
