Proportionate to the possible risks of a product, manufacturers shall, to protect the health and safety of consumers, carry out sample testing of randomly picked products made available on the market chosen under the control of a judicial officer or any qualified person designated by each Member State , investigate complaints and keep a register of complaints, non-conforming products and product recalls, and shall keep distributors informed of any such monitoring.
3. En fonction des risques qu'un produit est susceptible de présenter, les fabricants, dans le but de préserver la santé et la sécurité des consommateurs, mettent à l'essai, de façon représentative, des produits mis à disposition sur le marché qu'ils prélèvent au hasard, choisis sous le contrôle d'un huissier de justice ou de toute personne qualifiée désignée par chaque État membre, examinent les réclamations, conservent un registre des réclamations, des produits non conformes et des rappels de produits et, le cas échéant, tiennent les distributeurs informés du suivi effectué.

In order to remedy this situation, an agreement was reached in the form of Council Directive 92/12/EEC of 25 February 1992, the purpose of which was to harmonise the general arrangements for products subject to excise duty and the holding, movement and monitoring of such products.

This trust must therefore be matched both by the provision for and listing of these products or substances – a measure proposed by the Commission, which I welcome – bearing in mind that the new EU strategy on chemical products will involve the registration of around 30 000 substances – and by a preliminary evaluation of the risks inherent in each substance. In fact, the monitoring, registration and handling of chemical products and substances must be covered by a set of rules that is clear, easy to understand and appropriate to the purposes for which the use of such products is intended.
Pour cela, cette confiance devra passer à la fois par la prévision et l’énumération de ces produits ou substances - une mesure proposée par la Commission, que je salue (il ne faut pas oublier que la nouvelle stratégie de l’UE en matière de produits chimiques impliquera, notamment, l’enregistrement d’environ 30 000 substances -, et par une évaluation préliminaire des risques de chaque substance. En effet, le contrôle, l’enregistrement et la manipulation de produits et de substances chimiques méritent une discipline claire, facilement intelligible et appropriée aux fins prévues pour l’utilisation de tels produits.
