The Member States shall provide, within the framework of the European Judicial Network in civil and commercial matters established by Decision 2001/470/EC and with a view to making the information available to the public, a description of the national rules and procedures concerning protection measures in civil matters, including information on the type of authorities which are competent in the matters falling within the scope of this Regulation.

Each public consultation shall cover all subject matters relevant to the particular stage of the procedure, and one subject matter relevant to the particular stage of the procedure shall not be addressed in more than one public consultation; however, one public consultation may take place in more than one geographical location.

The procedural framework proposed is inspired by the empowerment mechanism set by Regulation No 662/2009 of 13 July 2009 establishing a procedure for the negotiation and conclusion of agreements between Member States and third countries on particular matters concerning the law applicable to contractual and non- contractual obligations and Regulation No 664/2009 of 7 July 2009 establishing a procedure for the negotiation and conclusion of agreements between Member States and third countries concerning jurisdiction, recognition and enforcement of judgments and decisions in matrimonial matters, matters of parental responsibility and matters relating to maintenance obligations, and the law applicable to matters relating to maintenance obligations. Le cadre procédural proposé est inspiré du système d'habilitation institué par le règlement (CE) n° 662/2009 du Parlement européen et du Conseil du 13 juillet 2009 instituant une procédure pour la négociation et la conclusion d'accords entre les États membres et des pays tiers sur des questions particulières concernant le droit applicable aux obligations contractuelles et non contractuelles et par le règlement (CE) n° 664/2009 du Conseil du 7 juillet 2009 instituant une procédure pour la négociation et la conclusion d'accords entre les États membres et des pays tiers concernant la compétence, la reconnaissance et l'exécution des jugements et des décisions en matière matrimoniale, de responsabilité parentale et d'obligations alimentaires, ainsi que sur le droit applicable en matière d'obligations alimentaires[3] .

Where the Commission issues a statement of objections relating to a matter in respect of which it has received a complaint, it shall provide the complainant with a copy of the non-confidential version of the statement of objections, except in cases where the settlement procedure applies, where it shall inform the complainant in writing of the nature and subject matter of the procedure.

130 | ( Existing provisions in the area of the proposal 1. Council Directive 89/107/EEC of 21 December 1988 on the approximation of the laws of the Member States concerning food additives authorised for use in foodstuffs intended for human consumption. The procedure laid down in the above Directive is close to the procedure established by this proposal in that it provides for the creation of a positive list of authorised additives at Community level. It differs from the procedure envisaged in this proposal as regards the following aspects in particular: the existing procedure is out of date insofar as it does not use the new framework for risk assessment in matters of food safety established by Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002 laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety; an additive is included on the positive list following the adoption of a directive under the codecision procedure, rather than by means of a regulation and the comitology procedure as envisaged by this proposal.

La procédure fixée par ladite directive se rapproche de la procédure établie par la présente proposition en ce qu'elle prévoit l'établissement d'une liste positive des additifs autorisés au niveau communautaire. Elle diffère de la procédure envisagée dans la présente proposition en ce qui concerne notamment les aspects suivants: La procédure existante est dépassée dans la mesure ou elle n'utilise pas le nouveau cadre d'évaluation des risques en matière de sécurité alimentaire fixé par le règlement (CE) n 178/2002 du Parlement européen et du Conseil du 28 janvier 2002 établissant les principes généraux et les prescriptions générales de la législation alimentaire, instituant l'Autorité européenne de sécurité des aliments et fixant des procédures relatives à la sécurité des denrées alimentaires. L'inclusion d'un additif dans la liste positive passe par l'adoption d'une directive en codécision, contrairement à l'instrument du règlement et à la procédure de comitologie prévus par la présente proposition.
