5. The information referred to in paragraph 1 and any Commission or Member State opinion under paragraph 4 shall be the subject of consultation, including, where appropriate, joint meetings between the Member State planning to reintroduce border control at internal borders, the other Member States, especially those directly affected by such measures, and the Commission, with a view to organising, where appropriate, mutual cooperation between the Member States and to examining the proportionality of the measures to the events giving rise to the reintroduction of border control and the threat to public policy or internal security.
5. B. whereas the border clashes started after a Cambodian court sentenced two Thai nationals to up to eight years‘ imprisonment, having found them guilty of espionage and illegal entry after they crossed into the disputed border area in December 2010, and whereas the sentence immediately followed the successful conclusion of the seventh meeting of the Joint Commission for Bilateral Cooperation between Thailand and Cambodia (JC), on 3-4 February 2011, at which both countries had agreed to extend cooperation in all areas and to hold a meeting of the Joint Commission on Demarcation for the Land Boundary (JBC) in Thailand in the near future,

The incident reporting scheme should be used by the Agency to transmit to the relevant national public authorities and to its Management Board (‘the Management Board’) any information concerning credible allegations of breaches of, in particular, Regulation (EC) No 2007/2004 or the Schengen Borders Code established by Regulation (EC) No 562/2006 of the European Parliament and of the Council , including fundamental rights, during joint operations, pilot projects or rapid interventions.

Article 11 of Regulation (EC) No 1638/2006 requires that the Commission adopt implementing rules laying down specific provisions for the implementation of Title III ‘Cross-border Cooperation’ and that the matters covered by the implementing rules include issues such as the rate of co-financing, preparation of joint operational programmes, the designation and functions of the joint authorities, the role and function of the joint monitoring and selection committees and of the joint secretariat, eligibility of expenditure, joint project selection, the preparatory phase, technical and financial management of Community assistance, financial control and audit, monitoring and evaluation, visibility and information activities for potential beneficiaries.

Nevertheless, the participating countries may also, in agreement with the European Commission, jointly identify large-scale cross-border investment projects which will not be selected through calls for proposals: these projects shall be specifically mentioned in the programme or be selected at a later stage by the Joint Monitoring Committee, referred to in Articles 11 to 13, provided that they are consistent with the programme's priorities and measures and that there is a budget specifically for this purpose.

The proposal for a framework decision against trafficking in human beings adopted by the Council last week is a Commission proposal. The communication on illegal immigration, the communication on repatriation policy and the communication on the joint policing of borders have been on the ‘scoreboard’ since May 2000 and are part of the Commission’s work programme that was submitted for debate in this Parliament this year. These are not the result of emergency measures arising from the terrorist attacks; they are an integral part of this Commission’s coherent and consistent immigration policy.
